Nov 4 is finally here!

To say tomorrow history will be made is an understatement. It however is not in the way you think.

Could it be that Barack Obama is Huey Long reincarnated? A chicken in every pot. Never has this country partaken of the Markist idealogy than it will should Barack Obama be elected as the 44th President tomorrow. Wake up America ... take your country back! We have allowed the lunatics to take over the asylum. In our apathy, we have allowed stupidity to regein. We allow OUR elected officials to subjugate themselves to parties rather than the people who put them into office.

We have watched as the media has decided not to relay information on candidates in order to influence the elections. In turn they have released hogwash (knowing that it was), in order to turn voters from other candidates. If a repudation is made later, it shows up in the hidden caches of printdom, somewhere between Aunt May's Miracle Constipation Formula Ad's and Carpet's R Us will clean any house for a Buck-forty.

Politics is a thinking man's game. A true American should be able to see through the spin and research on their own. People vote without knowing what they are voting for! Ask someone why they are voting, is it a credible decision? If they vote on economics, do they truly understand theory or just the pocket book?

Am I voting for John McCain and Sarah Palin? Yes. Why? It is not because Obama is a Democrat and not because he is black (Oh my God! someone finally said it!) It is because he hasn't a clue. About what? Where do I start. Joe Biden? You think he is an embarrasement now, just wait.

Mary Landrieu? Been there long enough and has never supported the overall interests of the people of Louisiana just the interests of Mary Landrieu. John Kennedy? Yes, fiscal conservative. Even his own party kept asking "Why are you a Democrat?". I voted for him when he was a Democrat so why not now?

Nough said.

I looked up the cases Amond cited and they do say "armed robbery" not "first degree robbery".

What gives?

Judge for yourself:

R.S. 14:64.1. First degree robbery

A. First degree robbery is the taking of anything of value belonging to another from the person of another, or that is in the immediate control of another, by use of force or intimidation, when the offender leads the victim to reasonably believe he is armed with a dangerous weapon.

B. Whoever commits the crime of first degree robbery shall be imprisoned at hard labor for not less than three years and for not more than forty years, without benefit of parole, probation or suspension of imposition or execution of sentence.

Added by Acts 1983, No. 533, §1.

I hear that Mayor Roy is headed to DC for the inauguration. I wonder if the council is going to this "black historical event"??

Anonymous said...

Sorry Spanky.
If failure is and was your objective you are batting 1000. I stand corrected.

Anonymous said...

Why not answer the question? The cases do say armed robbery, that is a fact.

Now has the statute been amended since those cases are what's the deal. Perhaps you should read those cases in addition to the statute? You just might get a clearer picture of the situation than simply quoting the statute.

Spanky said...

You are forgiven, you are welcome, and with friends like you..........

Armed Robbery requires being armed with a dangerous weapon - it's an essential element of the crime. Every 1st semester law student understands this or they don't become a 2nd semester law student (at 3 of the 4 law schools).

The offense he committed, the offense he is convicted of, and the offense he is sentenced on is First Degree Robbery.

Aymond simply does not know what he is talking about. He is apparently aggravating his ignorance by his unwillingness to understand and admit it. This is only significant because of his totally unjustified attacks on Ed Hooper, who is a cretin and a mama's boy, but right about his legal posit.

Anonymous said...

You moran. Read ther two cases cited by Aymond that say you do not have to be armed with a gun to be gulity of armned robbery. I was asking you asshole moran if the law has changed? Why don't you read those two cases you idiot?

Anonymous said...

Besides, either charge correctly shows that it doesn't matter which charge it is, the sentence is fair and that it was possible for it to be much greater that it was. So the proposition was correct.

Anonymous said...

A dangerous weapon doesn't have to be a gun. It can be s knife or a stick or a can of peas but you have to actually have a dangerous weapon to be an armed robber. Why do you think the legislature enacted the 1st Degree Robbery article? As any good criminal practitioner: defense or prosecution. Quit making such a fool of yourself.

The cases of State v. Harrison, 501 So.2d 1041 (La. App. 2 Cir., 1987)and State v. Ellis, 672 So.2d 1007 (La.App. 5 Cir., 1996)stand for the proposition that a finger can be a weapon. Thus it equals armed robbery. End of story.

The question is, as has been asked constantly, has the law changed since 1996. Answer that question now dumbass.

AN ABSOLUTE MUST READ BY EVERY AMERICAN!

PLEASE PASS THIS ON

Juval Aviv was the Israeli Agent upon whom the movie ' Munich ' was based. He was Golda Meir's bodyguard -- she appointed him to track down and bring to justice the Palestinian terrorists who took the Israeli athletes hostage and killed them during the Munich Olympic Games.

In a lecture in New York City a few weeks ago, he shared information that EVERY American needs to know -- but that our government has not yet shared with us.

He predicted the London subway bombing on the Bill O'Reilly show on Fox News stating publicly that it would happen within a week. At the time, O'Reilly laughed and mocked him saying that in a week he wanted him back on the show. But, unfortunately, within a week the terrorist attack had occurred.

Juval Aviv gave intelligence (via what he had gathered in Israel and the Middle East ) to the Bush Administration about 9/11 a month before it occurred. His report specifically said they would use planes as bombs and target high profile buildings and monuments. Congress has since hired him as a security consultant.

Now for his future predictions. He predicts the next terrorist attack on the U.S. will occur within the next few months.

Forget hijacking airplanes, because he says terrorists will NEVER try and hijack a plane again as they know the people onboard will never go down quietly again. Aviv believes our airport security is a joke -- that we have been reactionary rather than proactive in developing strategies that are truly effective.

For example:

1) Our airport technology is outdated. We look for metal, and the new explosives are made of plastic.

2) He talked about how some idiot tried to light his shoe on fire. Because of that, now everyone has to take off their shoes. A group of idiots tried to bring aboard liquid explosives. Now we can't bring liquids on board. He says he's waiting for some suicidal maniac to pour liquid explosive on his underwear; at which point, security will have us all traveling naked! Every strategy we have is 'reactionary.'

3) We only focus on security when people are heading to the gates.

Aviv says that if a terrorist attack targets airports in the future, they will target busy times on the front end of the airport when/where people are checking in. It would be easy for someone to take two suitcases of explosives, walk up to a busy check-in line, ask a person next to them to watch their bags for a minute while they run to the restroom or get a drink, and then detonate the bags BEFORE security even gets involved. In Israel , security checks bags BEFORE people can even ENTER the airport.

Aviv says the next terrorist attack here in America is imminent and will involve suicide bombers and non-suicide bombers in places where large groups of people congregate. (i. e., Disneyland, Las Vegas casinos, big cities (New York, San Francisco, Chicago, etc.) and that it will also include shopping malls, subways in rush hour, train stations, etc., as well as rural America this time (Wyoming, Montana, etc.).

The attack will be characterized by simultaneous detonations around the country (terrorists like big impact), involving at least 5-8 cities, including rural areas.

Aviv says terrorists won't need to use suicide bombers in many of the larger cities, because at places like the MGM Grand in Las Vegas , they can simply valet park a car loaded with explosives and walk away.

Aviv says all of the above is well known in intelligence circles, but that our U. S. government does not want to 'alarm American citizens' with the facts.

The world is quickly going to become 'a different place', and issues like 'global warming' and political correctness will become totally irrelevant.

On an encouraging note, he says that Americans don't have to be concerned about being nuked. Aviv says the terrorists who want to destroy America will not use sophisticated weapons. They like to use suicide as a front-line approach. It's cheap, it's easy, it's effective; and they have an infinite abundance of young militants more than willing to 'meet their destiny'.

He also says the next level of terrorists, over which America should be most concerned, will not be coming from abroad. But will be, instead, 'homegrown' -- having attended and been educated in our own schools and universities right here in the U. S. He says to look for 'students' who frequently travel back and forth to the Middle East . These young terrorists will be most dangerous because they will know our language and will fully understand the habits of Americans; but that we Americans won't know/understand a thing about them.

Aviv says that, as a people, Americans are unaware and uneducated about the terroristic threats we will, inevitably, face. America still has only have a handful of Arabic and Farsi speaking people in our intelligence networks, and Aviv says it is critical that we change that fact SOON.

So, what can America do to protect itself?

From an intelligence perspective, Aviv says the U.S. needs to stop relying on satellites and technology for intelligence. We need to, instead, follow Israel 's, Ireland 's and England 's hands-on examples of human intelligence, both from an infiltration perspective as well as to trust 'aware' citizens to help. We need to engage and educate ourselves as citizens; however, our U. S. government continues to treat us, its citizens, 'like babies'. Our government thinks we 'can't handle the truth' and are concerned that we'll panic if we understand the realities of terrorism. Aviv says this is a deadly mistake.

Aviv recently created/executed a security test for our Congress, by placing an empty briefcase in five well-traveled spots in five major cities. The results? Not one person called 911 or sought a policeman to check it out. In fact, in Chicago , someone tried to steal the briefcase!

In comparison, Aviv says that citizens of Israel are so well 'trained' that an unattended bag or package would be reported in seconds by citizen(s) who know to publicly shout, 'Unattended Bag!' The area would be quickly & calmly cleared by the citizens themselves. But, unfortunately, America hasn't been yet 'hurt enough' by terrorism for their government to fully understand the need to educate its citizens or for the government to understand that it's their citizens who are, inevitably, the best first-line of defense against terrorism.

Aviv also was concerned about the high number of children here in America who were in preschool and kindergarten after 9/11, who were 'lost' without parents being able to pick them up, and about ours schools that had no plan in place to best care for the students until parents could get there. (In New York City , this was days, in some cases!)

He stresses the importance of having a plan, that's agreed upon within your family, to respond to in the event of a terroristic emergency. He urges parents to contact their children's schools and demand that the schools, too, develop plans of actions, as they do in Israel .

Does your family know what to do if you can't contact one another by phone? Where would you gather in an emergency? He says we should all have a plan that is easy enough for even our youngest children to remember and follow.

Aviv says that the U. S. government has in force a plan that, in the event of another terrorist attack, will immediately cut-off EVERYONE's ability to use cell phones, blackberries, etc., as this is the preferred communication source used by terrorists and is often the way that their bombs are detonated.

How will you communicate with your loved ones in the event you cannot speak? You need to have a plan.

it is my understanding the coach came to basketball practice "under the influence". Allgood went to his home to talk to him after parents complained. after Allgood took him to see his priest things seemed ok. the next day he showed up at school creating a scene and was asked to leave school grounds by Allgood. he appeared to be in the process of leaving and unexpectedly turned around and viciously attacked Allgood. i understand he is now in a rehab facility.

My pride and faith have returned. Mayor Roy had the gumption to, by his apparent physical absence, demand respect for himself and his office. The Council was distressed and perhaps hamstrung by the inconvenience of having to respectfully request information and assistance of the Administration and hopefully will recognize that the problem was unilaterally created by their attempt to put our mayor in what they perceive to be "his place".
Bravo! Roy is back and he is smarter.

Anonymous said...

Roy does not need to attend a Council meeting unless he requested by the Council. He is a real drag for progress.

Anonymous said...

The only reason for Roy to attend the council meetings is to impart information and understanding to the council. They need his input and he deserves their respect and appreciation, not their abuse.

Fact: Lt. Michael Renier got transferred from his normal duties because he or his officers stopped Rosevelt and his family for serious traffic infractions on a number of occassions and permitted someone under his supervision to write Rosevelt a ticket. I will lose my job if I report this to KALB but I hope that Mr. Magnoli picks up on this and checks it out.

The drainage issues are not being addressed even when the administration 'addresses' them. Smoke and mirrors.

If anyone wants to know more about one of the main causes for the recent flooding problems they need to look into Home Depot, what they should have been required to do regarding the runoff their parking lot would cause-and what they were actually allowed to get away with.....

Anonymous said...

Mr. Magnoli, who was arrested last weekend for DWI and having out of state tags, you want him to investigate the police/city council??? I am sure he will be more than willing.

The council took the mayor's seat and reminded him that they were City Council meetings. Maybe they do need him and his staff after all.

Public records advocate, pundit, political analyst, and Alexandria's moral compass, Gregory Aymond, apparently does not know that arrests records are public records and do not constitute a breach of public duty or slander. Poor guy: he tries so hard and gets so little right . . . .

Just half? Sucks. Now I am disappointed again. Politics is making me sick to my stomach.

Anonymous said...

I find irony and humor in the fact that KKKaymond is turning to Myron Lawson for help after he called him a criminal, crook, and the "n" word.

Anonymous said...

You dolt why do you find it ironic? Lawson may be all of those things but he is still an elected official with an obligation of duty to the citizens.

How many timnes have you cussed the police but bet you would call on them if you needed help.

It may surprise you that present city administration is "all hat no cows." All Roy has done is talk, tried to make everything the Council fault and announced great future plans.

Try this situation which, in my opinion, describes the operation of government in and around Alexandria. The recently elected lady judge, maiden name Lauve, is the sister to Attorney Lauve who is a contracted lawyer for the City - our city legal department has to have outside help to do the job.

Wonder if a case comes before her whereas he is the attorney if she will recuse herself?

oh give me a break. lawson's just using aymond and aymond's too stupid to know he's being used. amyond tried to get a blog interview with roy and roy said thanks but no thanks.

lawson thinks by helping aymond out he can peel away white conservatives from roy.

if aymond is serious about this, why doesn't he get lawson to sit down for a blog interview???

imho, aymond seems unhinged.

Anonymous said...

"seems...??????"

Anyone who has even the most casual contact with Aymond knows he is unhinged.

That fact, coupled with just enough legal training to be a pain in the ass and cost someone money, is the reason many are afraid of him.

The solution to Aymond is to take him out back and thrash the living hell out of him...like I did.

Aymond is a blowhard. When you call his bluff, he folds. He's a coward at heart.

Greg aymond said...

I wrote to Myron Lawson simply as my Councilman, which I have the right to do.

I hasve not conducted any interviews because my speach has been messed up since my stroke in October.

You can attempt to attack me to the other 53 people that have read this blog today. In the meantime, I will continue blogging. Check out my blog if you ever want to see something of interest.

Greg Aymond said...

Oh, by the way, the previous commenter is a liar. Nobody has "thrashed the living Hell" out of me since high school, over 30 years ago.

Anonymous said...

As we age we become less invincible. However, I get the impression that Aymond, as a young man, was "aiborne", etc, etc. I would like a brief overview of his military history. Maybe before old age illness he was "stout." If you whupped him after the stroke you really a bad ass. Do you beat old old women for fun?

One would think he still would not run from a fight. Easy to be a bad ass anonamously. Tell us who you are.

We want to know who "whupped" Aymod. Did you ever jump with full pack, weapon, etc? Hell we might even get you a trophy. Being a real live hero and an Aymond ass whupper rates that.

Anonymous said...

That really begs the issue, Aymond did not acquire his present unfortunate standing or reputation bacause of his pugilistic skills.

I agree with the previous poster who observes that someone who publically, in print and in press, calls an African American public official an unethical, dishonest, self-serving "nigga" and then stoops to ask him for help shows a deep emotional or mental illness.

Can you imagine the glee that Myron felt when he got this pleading whinning letter from his local KKK accuser?

Aymond was a huge fan of the Mayor and admministration until they got tired of his shit and ignored him. Now he wants Roy's head on a spike.

A guy with a stroke shouldn't want fights and therefore, should not pick 'em.

Anonymous said...

And just who has Aymond picked a physical fight with recently?

Seems to me that Aymond is just speaking his mind.

Loser HaHaHa

Anonymous said...

Be he a niggah or not he is a public servant. It is incumbent upon a public servant to continue to do his duty no matter what.

Sure would be nice to appear before a Judge who could not set his personal feelings aside and fairly conduct a trail. You think Judges might like some lawyers better than sothers. I am sure Lauve's sister (the Judge) has sibling love for her brother. Even if she recused herself from hearing a case involcing her brother without professional ethics she could attempt to influence.

Anonymous said...

The council president's role is not to command the executive branch to answer mail inquiries. No, Greg was clearly asking Myron to intervene on his behalf as a favor. Obviously Greg was trying to tattle on the mayor and give him some ammmo on the the "transparency" issue. Greg obviously had no loyalty to anyone or anything and those who deal with him need to be aware. Ask Phil Terrell.

Anonymous said...

You can stop speculating and makining up your worthless bullshit. Harry Silver requested that Aymond write to Lawson, asnd he did. It was Myron's job to represent all his his constituents, and that he did.

That's the way governemt works, you got a problem you tell your elected official. I love it when government works the way it is supposed to.

Anonymous said...

it is what it is

Anonymous said...

It's really not important. It just provides some insight into how little Aymond understands about how his conduct, actions and character are perceived. Maybe he is autistic. They are frequently unable to gage other's reactions to or about them.

Kind of a pity. He seems bright enough.

Anonymous said...

It must be important. It is really amazing how much control Aymond has over your life. You constantly belitle him - does he bother you that bad. I truly believe he occupys your brain every moment you are awake.

It is mind numbing to see someone so consumed by the existance of another human being that the only life they have is attackting Amond. You know, I'll bet if we knew who you are you would be found to be saddled with numerous mental problems.

Hell I almost feel sorry for a piece of lifeless shit like you. I may or may not care for Aymond but I don't constantly fixate on him. He is just another white southern boy that this nation fucked with and fucked up by sending the pride of our youth to the Nam. Friend he has reasons to be fucked up if he is. His efforts as well as the efforts of many more , especially those named on the wall, have never been thanked for their efforts

What are your reasons for being fucked up?

Anonymous said...

That you find it necessary to drum up excuses for Greg's conduct shows that you know he ain't quite right. I am satisfied that you recognize his malady enough to defend it. Perhaps you are a mental health advocate.

All people have personal failures. You are remarkable in that you seem proud of yours. Sicko

I think that you are full of shit.

Get a life besides me.

Anonymous said...

Mr Aymond, it's lawyers like you that give the whole profession a bad reputation.

You say, "After all, its the clients case, not the lawyer's."

Not true.

A client comes to you when, for whatever reason, his situation requires representation in the legal arena. When you agree to represent that client, you take on the mantle of protector of your clients rights and advocate of your client's best interests.

With your callus remark you have shown that you believe your client is nothing but a billing source, and proved that you deserve your reputation as a man without integrity.

Small wonder that most members of the local bar treat you either as a pariah, or a buffoon.

In my opinion, both adjectives fit well.

Anonymous said...

All lawyers have bad reputations. Even when you need one. Tbhey swim with their brother the shark and live as bottom feeders.

You can't single out one lawyer as as bad.

Anonymous said...

If you have that opinion of lawyers, then Aymond must be yours.

Look up the word "shyester" in the dictionary. You'll see Aymond's picture.

Anonymous said...

Look, everyone knows that Aymond is a crappy lawyer.

He practices out of the back of a plumbing shop.

He chases ambulances and slip and fall cases.

His ignorance of the law is legendary.

He got his hand cought in the till over at Water Works District 3 and was fired.

He hates Roy Hebron because Hebron encouraged the water district to fire him for padding the bills.

He hates Rich Dupree because Dupree has whipped his ass in court every time they have butted heads.

He hates Clarence Fields because he's black.

Aymond still keeps his Klan robes clean and freshly starched, hanging in his closet.

All this is common knowlege in Cenla. Aymond is one of the most twisted minds anyone will encounter outside of a mental institution.

His local blog is merely a vehicle for him to spew his laughable opinions... because no body really pays attention to him.

All this makes him..."colorful"

It also makes him a rather sad, unimportant little gnome.

But...our life is richer because of Aymond. He makes the perfect target for anyone looking for something to wipe their ass with.

Lawson's attempt to use his official position to fire the gold firm while they are trying to enforce a legal right of the city against him constitutes a major ethical breach and it is my hope that someone of courage and sophistication will bring another complaint against him. He was advised in writing and in public meeting that the conduct was a potential breach.

Anonymous said...

The irony is that the only person with the moral courage to call Lawson on his shit is Greg Aymond. You jump his ass and accuse him of all sorts of stuff but when stuff needs to be done we rely on Aymond to do it.

Goins and Lardvadamn are the most crooked councils members but only next to Liar Lawson. He is the biggest crook ever, a liar and a thief. Finally we have 4 councilmen to stand up for all of out city. Finally Mr. Hobbs and Mr. Johnson are not following crooked Lawson. I never thought I would live to see the day.

Anonymous said...

Roy got the formula. Instead of trying to find intelligent councilmen and trying to pursuade them to do the right thing, he has two unemployable parasites and enough leverage/good will with the Sheriff to be able to get them deadhead jobs. It worked so well with Smith that he tried it with Hobbs and Johnson and, as you can see, it works like a charm. He bought himself a majority. It rarely happens but Lawson was outsmarted at city hall.

Anonymous said...

Myron Lawson is a crooked black man.Watch out for him, he is only out for himself.

Thank you. The sudden religious conversion of Hobbs and Johnson was a confusing mystery to me until your explanation. Everyone knew they could be bought we just didn't know who the highest bidder was until now. Thank you.

One small problem with theory... neither Hobbs nor Johnson work for the RPSO.

Johnson did work for them a few months ago, but not anymore.

Greg Aymond has shot himself in the foot, AGAIN!

He says that we should vote against the tax re-distribution because Ball Mayor Roy Hebron is corrupt.

This is the same lawyer who got caught padding his bills to Water Works #3, caught falsifying evidence in a civil case, has been before the disipilanary board countless times, an card carrying member of the KKK, scourge of the local bar association..... The list goes on and on.

Aymond is scum, this community would be a lot better off without him.

Anonymous said...

I see discussions about the Alexandria mayor and administration getting pay raises but can't find anything in the Town Talk. What's the deal?

Anonymous said...

You say that Aymond has been "padding his bills to Water Works #3, caught falsifying evidence in a civil case, has been before the disipilanary board countless times, an card carrying member of the KKK, scourge of the local bar association".

Prove it. Any of it. Or shut the fuck up.

Marginally literate Ed Hooper admits to having little education but says that he did spend some time in the Navy and proceeds to use language designed to confirm that. He addresses a number of pointed insults to his intellect and manhood launched by Greg Aymond but leaves out the part about living with and off of mama. Interesting.

Anonymous said...

Concerning Aymond...I don't need proof of any specific allegation. I know Aymond well. Simply put, he's a coward.

He hides behind his blog taking potshots at those his twisted little mind has decided are "unworthy."

He waddles into a courtroom and attacks his enemies with language that he would never use face to face.

Aymond has chosen two venues where he can boast and preen without fear of counter attack.

This is the calculated action of a spineless man who fears confrontation because he knows he is inadequate.

Aymond can be truthfully called many despicable things, but it his obvious cowardice that makes him such a loathsome creature

Anonymous said...

We know Aymond's name because he has the courage to provide it while you (and I) hide behind "anonymous". You don't have the right to accuse anyone else of cowardice.

Anonymous said...

...and you, my dull witted friend missed the point of my entire post.

Aymond is a true coward because he feigns courage only where they can be no retaliation. He beats his chest and roars when there is no possibility that his target can damage him in return.

When there is any inkling of his target damaging him in return, Almond slinks away to the nearest corner to suck his thumb, devour cases of Twinkies, and show his true spineless nature.

Aymond is a man of limited intelligence, limited imagination, and absolutely void of personal conviction. He is the epitome of cowardice.

Anonymous said...

"only where they can be no retaliation. He beats his chest and roars when there is no possibility that his target can damage him in return."

I don't understand that remark. Aymond names himself and the one's that he talks about. Why can't there be retaliation by the ones he names then? Sound like you are a big idiot to me.

Anonymous said...

"...Aymond names himself and the one's that he talks about. Why can't there be retaliation by the ones he names then?"

Think about it. Who are his main targets? The City of Pineville? Mayor Fields? Rich Dupree? Roy Hebron? Water Works #3?

He has lost every legal action taken against the City of Pineville. In the last election cycle both Mayor Fields and Mayor Hebron were sent back into office without opposition. He also rails against Rich Dupree and his lack of a college degree, however, Dupree has spanked Aymond every time the two have met in court. And...if you listen to Aymond, the courtroom is where he claims to reign supreme.

Aymond only chooses two forums to beat his chest and tell the world what a man he is...the courtroom, where he looses on a regular basis, and his blog, where he refuses anyone to comment unless they agree with him.

When was the last time you saw Aymond attend a public meeting of any of the governmental bodies that he attacks? When has he ever appeared in public to protest anything?....unless he was cloaked in his freshly starched Klan robes? When has he ever subjected himself to counterattack in order to advance his protests against the imaginary wrongs of local officials?

No...Aymond claims that he has courage because he attaches his name to his inane writings. I contend that this is not an act of courage, but cowardice. He identifies himself once he had made certain that his target cannot retaliate. Then he spews false accusations and misleading information.

By any account Aymond is a feckless coward.

Anonymous said...

The last post about Aymond and his lack of balls makes perfect sense to me.

And...it's true. Aymond has never posted anybody on his blog that disagrees with him.

Not only is he gutless, he believes in censorship.

Greg Aymond said...

Aymond DOES censor the speech of others, and he DOES NOT attack those who can and will retaliate.

Aymond is a gutless coward.

Anonymous said...

the council spent years talking about how hard it is to hire people because of the idiot director of civil service. they just want to get rid of the fool who thinks she runs a shadow government.

within the last few months the civil service commission tried to reprimand a city employee for following a judge's order and testifying that jonathan goins couldn't actually live in his district... at least if he wanted to brush his teeth and take showers. this was a complaint filed by jonathan goins attorneys partner.

the employee sued and won...

then the civil service board hired jonathan goins attorney- tommy davenport- as their lead counsel.

if you want to talk about patronage you should look at the bullshit goins is trying to do with civil service... all because his butt is sore from being exposed as living in a fancy apartment in the lakes district.

Anonymous said...

who was the concerned citizen? what were they complaining abou? hard to address an issue with no facts.

Anonymous said...

Although I was not in attendance at Monday's Zoning Hearing, I have heard about the results. Mind you, this is all hearsay.

The property owner for a tract at the intersection of jackson Street Extension and Warren asked that a variance be granted so a "family style" resturant be permitted. According to my sources, liquor would be served.

The chairman of the board suggested the request be tabled until all the particulars could be determined. As chairman, he doesn't vote on such matters.

One citizen in attendance challenged John Rodth's "conflict of interest" and he recused himself.

Despite the objection to the variance by most of those in attendance, the board voted to pass the matter on to the city council.

This is typical of the zoning board. If a prominent land owner or developer is involved, you can put money on the board passing on their responsibilities and caving in to the "powers that be"!

John Rodth made the motion. Dick Sterkx had to recuse since his wife is a Realtor at Noles Frye as well. And now you know the rest of the story.

The difference between Robbi G's and this corner? This is the only lighted intersection where people can easily turn right or left. Warren is not as heavily traveled because it's narrow and difficult to get out of Jackson from.

Anonymous said...

My source of information concerning Monday's zoning hearing has now told me that it was indeed Richard Sterkx who was recused from voting on the requested variance for Warren and Jackson Street Extension.

Anonymous said...

Yikes! The tract of land being considered for rezoning is not at the corner of Jackson Street Extension and Warren Street, it is at the corner of Jackson Street Extension and Maureen.

Yes, it's Maureen and Jackson. The potential developer is Spencer Marks, son of Nat and Dr. Marks. Selling the property are Maurice Hebert (Commercial Properties) and Ed Hixson who just had a group home vacate his property.

My favorite part - maybe the City of Alexandria needs to hire a non-lawyer as the City Attorney. Apparrently Aymond and Heath knew more than Chuckie.

Mr. Aymond, I knew that there was a pending lawsuit between the city
of Alexandria and Mr. Heath. I knew that the documents he was
requesting were properly obtainable through discovery and not through
a public records request. I explained that to him on the phone. I thought
that I was being a courteous public servant by calling him personally
and telling him that your lawyer can get these documents through
The rules of discovery do not appear to have any bearing on a member 1 of the public’s right of
access under the Public Records Law. In Bauer v. Maestri, 96-112 (La.App. 5 Cir. 6/7/96), 676
So.2d 1096, Bauer, a parish employee who had five pending civil service appeals with Jefferson
Parish, sought to compel production of various parish government documents. On appeal, Jefferson
Parish argued that, because Bauer had originally sought the documents through discovery in
connection with his ongoing lawsuit with the parish, the documents were exempt from disclosure
under the Public Records Law. The fifth circuit rejected Jefferson Parish’s argument stating, “such
a denial of discovery would not be dispositive of Bauer’s right to access under the Public Records
Law.” Id. at 1100.

discovery. The discovery rules trump the public records law if there is
a suit filed.[1] [Heath] didn’t understand that because he is not a lawyer
or for whatever reason. I object to his characterization that I was
agitated. I deal with hundreds of requests like this all the time, sir.

However, La.R.S. 44:4(15) does not to apply for two reasons. First, we note
that even if the records in question were found to be exempt from disclosure under
the Public Records Law, Heath was entitled to receive a final written determination
as to whether he had the right of access to the records within five days from his
request, exclusive of Saturdays, Sundays, and legal holidays. La.R.S. 44:35(A). At
trial, Heath’s attorney asked Johnson whether he provided Heath with a written
determination:
Q. Alright. Did you at any time, any time, notify Mr. Heath in writing
the reasons why he was not getting the documents he had requested in
writing?
A. No, I did not and I didn’t have to because I knew there was a pending
suit between the city and - -
Q. Well, we’re not - -
A. - -Mr. Heath- -
Because Heath was never provided a final written determination regarding his right
of access to the public records, the custodian of said records is in violation of the
Public Records Law.
Second, it is clear that the records in question are not exempt from disclosure
under La.R.S. 44:4(15). In adopting La.R.S. 44:4(15), the legislature was seeking to
protect the work product of state, parish, and municipal attorneys.

• By making payments of rent to Councilman Myron Lawson for the lease of office space;
• At a time when Bridgett Brown was a party to a contract with the City of Alexandria to perform legal work for the city;
• At a time when Councilman Myron Lawson was prohibited by Section 1111C(2)(d) of the Code of Governmental Ethics from receiving such compensation.

Some on needs to get to our mayor and EXPLAIN to him that we DO NOT WANT TO BUY THE BENTLEY HOTEL. ( Did I really say that loud enough?) What part of "NO" does he not understand? He needs to concentrate on our drainage system. So many homes are going under water and the flooding issue is out of control. Just put anything about the hotel business to a vote and see what our tax paying citizens need and want. Another storm and big rain and more property damaged. Neighbors are leaving outdoor lights on when it is raining and staying up, hoping and praying our homes will not flood again.

Spanky with reference to your remarks on Robert Morgan's blog site I would like to extract some lines from the Appeals Court decision to show just how arrogant and egotistical our light skinned Clahoun Jr. City
Attorney is:

"Q. Alright. Did you at any time, any time , notify Mr. Heath in writing the reasons why he was not getting the documents he had requested in writing?

A. No, I did not and I didn't have to because I knew there was a pending suit between the city and --"

The Cith Attorney of Alexandria knows (by his own admission) he is above the law and does not have to comply with the law. Typical attitude of the Executive Branch of the City of Alexandria.

So even if one is armed with the law if the City Attorney "knows" what he has to do no matter what the law says it does not get done. Talk about abuse of power. Maybe Calhoun Jr. needs to return from whence he came. He is obviously on a power trip.

Spanky said...

Uh, that is why the Court of Appeals exists - to rectify ignorance and arrogance. It really does work sometimes.

Anonymous said...

That is the purpose of the Appeal process but seems like a needless expense to have to go through the appeal process when the wording of the law is so simple.

Do our local Judges have the ability to read and comprehend or are they just pandering to local political leaders for future political support?

Pineville and Alexandria and local Judges have displayed an obvious disdain or a complete disregard for the provisions of law.

It has been rumored that higher judicial office is desired by a local judge. It would be interesting to find out how many times this Judge has been reversed by the Appeals court. This would indicate the qualifications for current position much less being qualified for higher office.

However joe citizen is forced to spend more money on legal costs in order to reach the Appeal level and have erroneous decisions reversed.

Spanky said...

If you look deeper, you may find an appeal scorecard does exist when it comes to judge's records. The Supreme Court of La keeps records on judges. Call them.

Spanky Greg Aymond ran down some percentages on local Judges reversal rate and it looks like I owe Randow an apology. He has almost the lowest reversal rate. Scary - especially when you view the reversal rates of others. It appears that with the exception of Randow and one other if you go before any other Judge just appeal his decision because percentages indicate the rest are more often wrong than ight.

Fine justice we have here.

Anonymous said...

Judge F. Rae Swent: had a total of 99 cases appealed with 60 reversed for 61%.

Judge George Metoyer: 171 cases 95 reversed 56%

Judge Donald Johnson: 25 cases 14 reversed 56%

Judge Tom Yeager: 70 cases 35 reversed 50%

Judge Patricia Koch: 45 cases 17 reversed 38%

Judge Harry Randow: 103 cases 37 reversed 36%

Judge John Davidson: 199 cases 64 reversed 32%

This is the justice we elect and pay for. Wonder how many deisions are not appealed? Be interesting to know the percentage of justice denied because of finances (not being able to afford to go any further)
