Nov 4 is finally here!

To say tomorrow history will be made is an understatement. It however is not in the way you think.

Could it be that Barack Obama is Huey Long reincarnated? A chicken in every pot. Never has this country partaken of the Markist idealogy than it will should Barack Obama be elected as the 44th President tomorrow. Wake up America ... take your country back! We have allowed the lunatics to take over the asylum. In our apathy, we have allowed stupidity to regein. We allow OUR elected officials to subjugate themselves to parties rather than the people who put them into office.

We have watched as the media has decided not to relay information on candidates in order to influence the elections. In turn they have released hogwash (knowing that it was), in order to turn voters from other candidates. If a repudation is made later, it shows up in the hidden caches of printdom, somewhere between Aunt May's Miracle Constipation Formula Ad's and Carpet's R Us will clean any house for a Buck-forty.

Politics is a thinking man's game. A true American should be able to see through the spin and research on their own. People vote without knowing what they are voting for! Ask someone why they are voting, is it a credible decision? If they vote on economics, do they truly understand theory or just the pocket book?

Am I voting for John McCain and Sarah Palin? Yes. Why? It is not because Obama is a Democrat and not because he is black (Oh my God! someone finally said it!) It is because he hasn't a clue. About what? Where do I start. Joe Biden? You think he is an embarrasement now, just wait.

Mary Landrieu? Been there long enough and has never supported the overall interests of the people of Louisiana just the interests of Mary Landrieu. John Kennedy? Yes, fiscal conservative. Even his own party kept asking "Why are you a Democrat?". I voted for him when he was a Democrat so why not now?

Nough said.

Why not answer the question? The cases do say armed robbery, that is a fact.

Now has the statute been amended since those cases are what's the deal. Perhaps you should read those cases in addition to the statute? You just might get a clearer picture of the situation than simply quoting the statute.

Armed Robbery requires being armed with a dangerous weapon - it's an essential element of the crime. Every 1st semester law student understands this or they don't become a 2nd semester law student (at 3 of the 4 law schools).

The offense he committed, the offense he is convicted of, and the offense he is sentenced on is First Degree Robbery.

Aymond simply does not know what he is talking about. He is apparently aggravating his ignorance by his unwillingness to understand and admit it. This is only significant because of his totally unjustified attacks on Ed Hooper, who is a cretin and a mama's boy, but right about his legal posit.

Besides, either charge correctly shows that it doesn't matter which charge it is, the sentence is fair and that it was possible for it to be much greater that it was. So the proposition was correct.

A dangerous weapon doesn't have to be a gun. It can be s knife or a stick or a can of peas but you have to actually have a dangerous weapon to be an armed robber. Why do you think the legislature enacted the 1st Degree Robbery article? As any good criminal practitioner: defense or prosecution. Quit making such a fool of yourself.

The cases of State v. Harrison, 501 So.2d 1041 (La. App. 2 Cir., 1987)and State v. Ellis, 672 So.2d 1007 (La.App. 5 Cir., 1996)stand for the proposition that a finger can be a weapon. Thus it equals armed robbery. End of story.

The question is, as has been asked constantly, has the law changed since 1996. Answer that question now dumbass.

Juval Aviv was the Israeli Agent upon whom the movie ' Munich ' was based. He was Golda Meir's bodyguard -- she appointed him to track down and bring to justice the Palestinian terrorists who took the Israeli athletes hostage and killed them during the Munich Olympic Games.

In a lecture in New York City a few weeks ago, he shared information that EVERY American needs to know -- but that our government has not yet shared with us.

He predicted the London subway bombing on the Bill O'Reilly show on Fox News stating publicly that it would happen within a week. At the time, O'Reilly laughed and mocked him saying that in a week he wanted him back on the show. But, unfortunately, within a week the terrorist attack had occurred.



Juval Aviv gave intelligence (via what he had gathered in Israel and the Middle East ) to the Bush Administration about 9/11 a month before it occurred. His report specifically said they would use planes as bombs and target high profile buildings and monuments. Congress has since hired him as a security consultant.




Now for his future predictions. He predicts the next terrorist attack on the U.S. will occur within the next few months.


Forget hijacking airplanes, because he says terrorists will NEVER try and hijack a plane again as they know the people onboard will never go down quietly again. Aviv believes our airport security is a joke -- that we have been reactionary rather than proactive in developing strategies that are truly effective.

For example:

1) Our airport technology is outdated. We look for metal, and the new explosives are made of plastic.

2) He talked about how some idiot tried to light his shoe on fire. Because of that, now everyone has to take off their shoes. A group of idiots tried to bring aboard liquid explosives. Now we can't bring liquids on board. He says he's waiting for some suicidal maniac to pour liquid explosive on his underwear; at which point, security will have us all traveling naked! Every strategy we have is 'reactionary.'

3) We only focus on security when people are heading to the gates.

Aviv says that if a terrorist attack targets airports in the future, they will target busy times on the front end of the airport when/where people are checking in. It would be easy for someone to take two suitcases of explosives, walk up to a busy check-in line, ask a person next to them to watch their bags for a minute while they run to the restroom or get a drink, and then detonate the bags BEFORE security even gets involved. In Israel , security checks bags BEFORE people can even ENTER the airport.



Aviv says the next terrorist attack here in America is imminent and will involve suicide bombers and non-suicide bombers in places where large groups of people congregate. (i. e., Disneyland, Las Vegas casinos, big cities (New York, San Francisco, Chicago, etc.) and that it will also include shopping malls, subways in rush hour, train stations, etc., as well as rural America this time (Wyoming, Montana, etc.).

The attack will be characterized by simultaneous detonations around the country (terrorists like big impact), involving at least 5-8 cities, including rural areas.

Aviv says terrorists won't need to use suicide bombers in many of the larger cities, because at places like the MGM Grand in Las Vegas , they can simply valet park a car loaded with explosives and walk away.



Aviv says all of the above is well known in intelligence circles, but that our U. S. government does not want to 'alarm American citizens' with the facts.



The world is quickly going to become 'a different place', and issues like 'global warming' and political correctness will become totally irrelevant.

On an encouraging note, he says that Americans don't have to be concerned about being nuked. Aviv says the terrorists who want to destroy America will not use sophisticated weapons. They like to use suicide as a front-line approach. It's cheap, it's easy, it's effective; and they have an infinite abundance of young militants more than willing to 'meet their destiny'.

He also says the next level of terrorists, over which America should be most concerned, will not be coming from abroad. But will be, instead, 'homegrown' -- having attended and been educated in our own schools and universities right here in the U. S. He says to look for 'students' who frequently travel back and forth to the Middle East . These young terrorists will be most dangerous because they will know our language and will fully understand the habits of Americans; but that we Americans won't know/understand a thing about them.

Aviv says that, as a people, Americans are unaware and uneducated about the terroristic threats we will, inevitably, face. America still has only have a handful of Arabic and Farsi speaking people in our intelligence networks, and Aviv says it is critical that we change that fact SOON.





So, what can America do to protect itself?



From an intelligence perspective, Aviv says the U.S. needs to stop relying on satellites and technology for intelligence. We need to, instead, follow Israel 's, Ireland 's and England 's hands-on examples of human intelligence, both from an infiltration perspective as well as to trust 'aware' citizens to help. We need to engage and educate ourselves as citizens; however, our U. S. government continues to treat us, its citizens, 'like babies'. Our government thinks we 'can't handle the truth' and are concerned that we'll panic if we understand the realities of terrorism. Aviv says this is a deadly mistake.

Aviv recently created/executed a security test for our Congress, by placing an empty briefcase in five well-traveled spots in five major cities. The results? Not one person called 911 or sought a policeman to check it out. In fact, in Chicago , someone tried to steal the briefcase!



In comparison, Aviv says that citizens of Israel are so well 'trained' that an unattended bag or package would be reported in seconds by citizen(s) who know to publicly shout, 'Unattended Bag!' The area would be quickly & calmly cleared by the citizens themselves. But, unfortunately, America hasn't been yet 'hurt enough' by terrorism for their government to fully understand the need to educate its citizens or for the government to understand that it's their citizens who are, inevitably, the best first-line of defense against terrorism.



Aviv also was concerned about the high number of children here in America who were in preschool and kindergarten after 9/11, who were 'lost' without parents being able to pick them up, and about ours schools that had no plan in place to best care for the students until parents could get there. (In New York City , this was days, in some cases!)



He stresses the importance of having a plan, that's agreed upon within your family, to respond to in the event of a terroristic emergency. He urges parents to contact their children's schools and demand that the schools, too, develop plans of actions, as they do in Israel .

Does your family know what to do if you can't contact one another by phone? Where would you gather in an emergency? He says we should all have a plan that is easy enough for even our youngest children to remember and follow.

Aviv says that the U. S. government has in force a plan that, in the event of another terrorist attack, will immediately cut-off EVERYONE's ability to use cell phones, blackberries, etc., as this is the preferred communication source used by terrorists and is often the way that their bombs are detonated.

How will you communicate with your loved ones in the event you cannot speak? You need to have a plan.

it is my understanding the coach came to basketball practice "under the influence". Allgood went to his home to talk to him after parents complained. after Allgood took him to see his priest things seemed ok. the next day he showed up at school creating a scene and was asked to leave school grounds by Allgood. he appeared to be in the process of leaving and unexpectedly turned around and viciously attacked Allgood. i understand he is now in a rehab facility.

My pride and faith have returned. Mayor Roy had the gumption to, by his apparent physical absence, demand respect for himself and his office. The Council was distressed and perhaps hamstrung by the inconvenience of having to respectfully request information and assistance of the Administration and hopefully will recognize that the problem was unilaterally created by their attempt to put our mayor in what they perceive to be "his place".
Bravo! Roy is back and he is smarter.

The only reason for Roy to attend the council meetings is to impart information and understanding to the council. They need his input and he deserves their respect and appreciation, not their abuse.

Fact: Lt. Michael Renier got transferred from his normal duties because he or his officers stopped Rosevelt and his family for serious traffic infractions on a number of occassions and permitted someone under his supervision to write Rosevelt a ticket. I will lose my job if I report this to KALB but I hope that Mr. Magnoli picks up on this and checks it out.

It may surprise you that present city administration is "all hat no cows." All Roy has done is talk, tried to make everything the Council fault and announced great future plans.

Try this situation which, in my opinion, describes the operation of government in and around Alexandria. The recently elected lady judge, maiden name Lauve, is the sister to Attorney Lauve who is a contracted lawyer for the City - our city legal department has to have outside help to do the job.

Wonder if a case comes before her whereas he is the attorney if she will recuse herself?

As we age we become less invincible. However, I get the impression that Aymond, as a young man, was "aiborne", etc, etc. I would like a brief overview of his military history. Sure would be nice to appear before a Judge who could not set his personal feelings aside and fairly conduct a trail. You think Judges might like some lawyers better than sothers. I am sure Lauve's sister (the Judge) has sibling love for her brother. Even if she recused herself from hearing a case involcing her brother without professional ethics she could attempt to influence.

The council president's role is not to command the executive branch to answer mail inquiries. No, Greg was clearly asking Myron to intervene on his behalf as a favor. Obviously Greg was trying to tattle on the mayor and give him some ammmo on the the "transparency" issue. Roy got the formula. Instead of trying to find intelligent councilmen and trying to pursuade them to do the right thing, he has two unemployable parasites and enough leverage/good will with the Sheriff to be able to get them deadhead jobs. It worked so well with Smith that he tried it with Hobbs and Johnson and, as you can see, it works like a charm. He bought himself a majority. It rarely happens but Lawson was outsmarted at city hall.

Think about it. Who are his main targets? The City of Pineville? Mayor Fields? Rich Dupree? Roy Hebron? Water Works #3?

He has lost every legal action taken against the City of Pineville. In the last election cycle both Mayor Fields and Mayor Hebron were sent back into office without opposition. He also rails against Rich Dupree and his lack of a college degree, however, Dupree has spanked Aymond every time the two have met in court. And...if you listen to Aymond, the courtroom is where he claims to reign supreme.

Aymond only chooses two forums to beat his chest and tell the world what a man he is...the courtroom, where he looses on a regular basis, and his blog, where he refuses anyone to comment unless they agree with him.

When was the last time you saw Aymond attend a public meeting of any of the governmental bodies that he attacks? the council spent years talking about how hard it is to hire people because of the idiot director of civil service. they just want to get rid of the fool who thinks she runs a shadow government.

within the last few months the civil service commission tried to reprimand a city employee for following a judge's order and testifying that jonathan goins couldn't actually live in his district... at least if he wanted to brush his teeth and take showers. this was a complaint filed by jonathan goins attorneys partner.

the employee sued and won...

then the civil service board hired jonathan goins attorney- tommy davenport- as their lead counsel.

if you want to talk about patronage you should look at the bullshit goins is trying to do with civil service... all because his butt is sore from being exposed as living in a fancy apartment in the lakes district.

Although I was not in attendance at Monday's Zoning Hearing, I have heard about the results. Mind you, this is all hearsay.

The property owner for a tract at the intersection of jackson Street Extension and Warren asked that a variance be granted so a "family style" resturant be permitted. According to my sources, liquor would be served.

The chairman of the board suggested the request be tabled until all the particulars could be determined. As chairman, he doesn't vote on such matters.

One citizen in attendance challenged John Rodth's "conflict of interest" and he recused himself.

Despite the objection to the variance by most of those in attendance, the board voted to pass the matter on to the city council.

This is typical of the zoning board. If a prominent land owner or developer is involved, you can put money on the board passing on their responsibilities and caving in to the "powers that be"!

of Alexandria and Mr. Heath. I knew that the documents he was
requesting were properly obtainable through discovery and not through
a public records request. I explained that to him on the phone. I thought
that I was being a courteous public servant by calling him personally
and telling him that your lawyer can get these documents through
The rules of discovery do not appear to have any bearing on a member 1 of the public’s right of
access under the Public Records Law. In Bauer v. Maestri, 96-112 (La.App. 5 Cir. 6/7/96), 676
So.2d 1096, Bauer, a parish employee who had five pending civil service appeals with Jefferson
Parish, sought to compel production of various parish government documents. On appeal, Jefferson
Parish argued that, because Bauer had originally sought the documents through discovery in
connection with his ongoing lawsuit with the parish, the documents were exempt from disclosure
under the Public Records Law. The fifth circuit rejected Jefferson Parish’s argument stating, “such
a denial of discovery would not be dispositive of Bauer’s right to access under the Public Records
Law.” Id. at 1100.

Because Heath was never provided a final written determination regarding his right
of access to the public records, the custodian of said records is in violation of the
Public Records Law.
Second, it is clear that the records in question are not exempt from disclosure

protect the work product of state, parish, and municipal attorneys.

He needs to concentrate on our drainage system. So many homes are going under water and the flooding issue is out of control. If any one cares to read the archives, we were discussing DG Hunter and the city council shenanigans several years ago and the eventual outcome and some of you folks said it would never happen. I will give a heads up on the next moves.

Hey Spanky! I wonder if the power plant was brought on line to use up some gas that was booked and not needed? There is a penalty if you over book. Since only one unit was running DG Hunter wouldn't carry the city load. Just a thought mind you........

It stands to reason. I drove by the day after the announcement and did not see much heat rising from the stacks or coolers. It kind of led me to believe other smoke was being blown other than from bunnishaDG Hunter stacks.

Spanky with reference to your remarks on Robert Morgan's blog site I would like to extract some lines from the Appeals Court decision to show just how arrogant and egotistical our light skinned Clahoun Jr. City
Attorney is:

"Q. Alright. Did you at any time, any time , notify Mr. Heath in writing the reasons why he was not getting the documents he had requested in writing?

A. No, I did not and I didn't have to because I knew there was a pending suit between the city and --"

The Cith Attorney of Alexandria knows (by his own admission) he is above the law and does not have to comply with the law. Typical attitude of the Executive Branch of the City of Alexandria.

So even if one is armed with the law if the City Attorney "knows" what he has to do no matter what the law says it does not get done. Talk about abuse of power. Maybe Calhoun Jr. needs to return from whence he came. He is obviously on a power trip.

That is the purpose of the Appeal process but seems like a needless expense to have to go through the appeal process when the wording of the law is so simple.

Do our local Judges have the ability to read and comprehend or are they just pandering to local political leaders for future political support?

Pineville and Alexandria and local Judges have displayed an obvious disdain or a complete disregard for the provisions of law.

It has been rumored that higher judicial office is desired by a local judge. It would be interesting to find out how many times this Judge has been reversed by the Appeals court. This would indicate the qualifications for current position much less being qualified for higher office.

However joe citizen is forced to spend more money on legal costs in order to reach the Appeal level and have erroneous decisions reversed.

If you look deeper, you may find an appeal scorecard does exist when it comes to judge's records. The Supreme Court of La keeps records on judges. Call them.

Spanky Greg Aymond ran down some percentages on local Judges reversal rate and it looks like I owe Randow an apology. He has almost the lowest reversal rate. Scary - especially when you view the reversal rates of others. It appears that with the exception of Randow and one other if you go before any other Judge just appeal his decision because percentages indicate the rest are more often wrong than ight.

Fine justice we have here.

Judge F. Rae Swent: had a total of 99 cases appealed with 60 reversed for 61%.


Judge George Metoyer: 171 cases 95 reversed 56%


Judge Donald Johnson: 25 cases 14 reversed 56%


Judge Tom Yeager: 70 cases 35 reversed 50%


Judge Patricia Koch: 45 cases 17 reversed 38%


Judge Harry Randow: 103 cases 37 reversed 36%

Judge John Davidson: 199 cases 64 reversed 32%

This is the justice we elect and pay for. Wonder how many deisions are not appealed? Be interesting to know the percentage of justice denied because of finances (not being able to afford to go any further)

It just goes to show that all humans are not infallible. Bear in mind that the appeals process resulted in another set of judges opinion.
