New Thread! New Thread!!!!

My humble apologies fellow blogians! I have been traveling out of state as of late, and am even now adding this thread from the great state of Texas. My cell phone was very active today with calls about Senator Vitter's visit to Alexandria today as well as Bobby Jindal's visit as well.

I am sure that our city councilmen are behaving a bit more conservatively these days... they may be next. The President of the New Orleans council resigned yesterday after being indicted by the feds after being caught accepting kick backs. His "take" was less than $15,000. He should have run for Congress where you are able to take $90,000 and allow it to go unreported!

Wait, Wait, wait just a minute. Stop the train. Roy raised hell, enticed a KKK man to rush to his aide, which fanned the fuels of racism, all because he didn't get his way on showing a meeting on a channel nobody watches, all over a fine of $100????

I thought folks were going to jail, being forced from office, etc. This is some BS!!!

Folks - the ethics complaint spoken of is independent of the "open meetings" violation. Word has it that there was a separate "ethics complaint" against MYRON only because of his office sharing arrangement with Bridgett Brown and his cramming her "less than needed" legal services down the City's throat. That is what has KING MYRON so worried. MYRON baby needs him a "lawyafohim."

Ask Fowler - I suspect he's trying to isolate himself from Myron and his puppets on the "open meetings" violation investigation by the A.G./D.A. Don't confuse a complaint with the ethics commission with an "open meetings" violation complaint with the A.G. or D.A. They are neither mutually extensive nor exclusive.

Keep your eyes on the ball here and don't get bogged down in the muck. Myron is a master at misdirection.

I watched this week's meeting and what I heard Fowler say was that he went and visited with his friend Judge Humphries in relation to passing the ordinance to hire Jock Scott. I did not hear him mention anything about asking him to defend him in the open meetings issue should it arise. He wanted his opinion on whether the case law being stated supported the ordinance since Humphries is the Humphries in Roy v Humphries.

As far as who remained in the room when they came back, only Chuck Fowler and CFS would not have been called and asked to vote because they didn't return to the meeting after the executive session - they went back to work. It would appear the phone calls or whatever means was used to poll the council only went to Myron, Harry, Louis, and Roosevelt.

I told you about a month and a half ago that you would begin to see the city council become very uncomfortable and that the actions would be shots across the bow - warning shots if you will.
Some of you scoffed.
Some of you are now paying attention.
Tell your councilman to staighten up and do right by the citizens or the severity and frequency will increase.

If the ethics complaint against Myron was filed by the local KKK Attorney-at-Law Plumber there is as much chance of something happening as a snowball surviving in hell. One would think the Atorney General and the Ethics Committee have a special file for their daily Aymond mail delivery.

What is cute is to watch this blog site operate on emotion instead of fact and knowledge. $100.00 HA HA HA and the penalty for and what constitutes a violation is contained in the City Charter.

Folks in the black community have become as apathetic as the white folks and think that someone will take care of whatever.

City Government has become a sideshow to the everyday person and most could care less.

When important issues are promoted by people of questionable or historically ineffective do-nothing reputations, it tends to deflect from the important issues and just be about the "promoter". I am told by persons familiar with your past and present that you are bright and insightful and amazingly sloth. Just consider the possibility that you (like Mr. Aymond) get in the way of and tend to obstruct real progress. Just wondering.

In order to clarify Spanky's $15,000.00 statement the following is presented. One would have to draw the conclusion that Spanky has Myron admitting to being guilty of receiving bribes and resigning. Hell of a leap even for Spanky.

I know the typical response will be how nitpicky. Courts operate on the meaning of laws. Laws are comprised of words. How the law is worded will determine what it means - as an example the $100.00 fine for Open Meeting violation. Bet that scared the hell out of the Council. As another example - Fowler hiring Humphries. He never said that. He said Humphries is his friend and he consults with him.

Scott cannot be compensated with taxpayer funds to represent or advise Myron in a lawsuit filed by a citizen unless Myron wins and an Ordnance is passed to reimburse Myron for his legal expenses.

Here is a fact. If Jock donates his advice and then gets a lucrative contract from those donees, he ends up with some pretty serious problems, as do the donees. It ain't as simple as you portray.

For instance, Trey says that Jock entirely drafted the original and amended ordinance for his contract. He donated his services (something of value) in order to get this contract. Is that a problem? Maybe. Does it smell really bad? I think so.

If your sincere interest is to improve upon the conditions that offend you, rather than to be noticed and adored, then you should consider whether you are helping or hurting the objectives you seek. It's about being selfish vs. selfless. And you are quite correct. You can do as you please. But if it is really about helping others, you need to think about your effect on the process.

I am willing to do my part. I have also found that honest effort to work within the framework of our local government have been fruitless. Therefore I choose to work from the periphery until our local government becomes dedicated to serve all people, regardless of race or economic status.

The assumption that a group of men can hold power and sway over the people is in error and my mission is to enlighten those that choose that path that real power comes from the people - even if it is one person.

A recent example is the last tax that was voted for. I was in favor of passage because of the stated goal of improving our police force to the level that community policing will be instituted. There was money in the budget to do the increase without the tax, but it took the express will of our community to make that statement it is the peoples will to have our security of person and property placed as #1 priority. Shouldn't that be a no-brainer and is the city council really looking out for us by not increasing security several years ago when it was really needed?

The city council showed their committment by making this move only after tax passage and not by rearranging priorities even though we had a surplus in the general fund that would have accommodated the increase in police and fire protection. In other words, allocating money for studies to out of state pet companies for dubious results take priority over our safety. Why?

These are the questions I want answered.

Number two fuel oil was extremely cheap this past winter and is a fuel that can be used at DG Hunter power station as replacement to natural gas. Why was that option not excerxised?

To me the "us versus them" is the vested interest in the outcome of City of Alexandria spending and ordinances versus the taxpayer-citizen.

This dichotomy alone indicates that the city has not operated in the best interest of its citizens.

Why is the billing of city utilities handled by a firm in Monroe? This fact alone provides a disconnect between citizen-customers and the vendor of services that is not regulated under any other auspices other thatn our local government. That is why when asked about utility rates, councilmen look at you and shrug. That move to Monroe was done on purpose to acheive that effect and alleviate responsibility from the council.

Until I get some straight answers for these and many other questions, I will continue to voice my opinion and stir others to become involved. Many others.

Until we get to the point of having at least 80% voter turnout, I consider any meager effort on my part a failure. I want all citizens to become involved in the future of our city. Only then will we become the success that has so long been talked about.

At the rate our elected officials are encountering legal problems (the Avoyelles Parish Sheriff, the New Orleans city councilman, etc.) it appears that it has been necessary for any candidate to have a felony conviction as a qualification to run for office!

Saw this in the Eddie Jordan case and wondered why some folks said the city council had to use personal money to defend themselves.

Jordan was tried and found guilty, yet the taxpayers will foot the bill.

How is that different in the council case, since none of them were "sued" personally, but as a group. Seems like a no-brainer that they, acting as a group, can hire Scott.

The city council was not sued. They were each being individually investigated for their individual violations of the open meeting law (those that took part in that illegal vote. If the Ag had decided to file suit and their were fined the $100, that would have come out of the individual pockets of each, not from the city. Totally different situation than Jordan in New Orleans.
As the council members faced individual liability, they would have to hire their own personal lawer. If the won in court, they could then get the city to pay them back.

No where are individuals cited. So the poster is right in that council can act as a body in this regards, since no one has filed against any one of them "personally."

No wonder our city sucks. It's schools do a poor job of teaching government. Please tell me you went to private school, so my faith will be restored in the public system.

All governmental bodies toward a majority, even if it's by one vote. So by filing against the majority, and not naming those in the majority, it therefore encapsulates the whole body.

Otherwise, taxpayers could refuse to pay taxes because they were following the minority that voted against the new taxes. Once a majority is established, it then becomes the reality for all (see Supreme Court rulings).

That's just way it works. Even in Alexandria.

This is absolute truth, but did you know that Butch, with the aid of Les Prestridge, also investigated you? Did you know that Butch was shown questionable billing records from you and vowed to “can that shyster…”

"Butch talked a big line and bragged about how he appointed a majority of that water board..." This is also true, and that Butch ordered his appointees to get rid of you. But did you know that the very people that you claim ousted you, actually protected you…refusing to call for your dismissal? According to members of the Board, your mother had just passed away and they refused to entertain such actions when you were grieving. Did you also know that Butch vowed to get rid of these very board members because that showed you respect and sympathy during your hours of grief?

Is anyone in charge in Alexandria City Hall? From a distance, admittedly, it appears as though there is continuing confusion as to what role everyone plays in governing the city. During the spring campaigns, everyone was talking about moving the city forward, economic development, downtown revitalization. What happened to all that enthusiasm? Now that there is need for action and no need for slogans, there doesn't seem to be any of either. And if there has been movement, it has been slow, very slow.

According to the book: The State & Secret Oath Bound Lodges;The Klu Klux Klan By J.M. Foster, initiation ceremonies are all basically the same with a few minor variations from lodge to lodge.
However, one key component in every ceremony is a vow to remain loyal to the KKK itself and to always uphold the Klan principals of racial purity.

As Foster states in his book... "nothing can separate a Klansman from his beliefs and his membership except death."

In Aymond's case, a simple check of his recent postings shows that, despite his protests, he still thinks and writes with a philosophy rooted in Klan doctrine.

Journalistic integrity requires that the Town Talk not accept statements made without doing proper research to determine the veracity of the statements. Before Cynthia Jordan began throwing around the word "illegal", she should have checked with the newspaper's attorney(s) to confirm whether Chuck Johnson and other "city attorneys" were correct in labeling the council's action "illegal."

Proper legal research would have shown that on September 1, 1983 in Opinion No. 83-738 issued by the Office of the Attorney General (State of Louisiana), it was ruled in a similar home rule charter environment, that the hiring of a special counsel by the city counsel on a continuing basis does not conflict with the duties and responsibilities of the City's Legal Deparment and City Attorney.

In fact, in the opinion, it was established that the council may retain special counsel to perform any legal services which are not prohibited by the Charter. Furthermore, it was ruled that although the City Legal Deparment shall direct and supervise the legal affairs of the City, it is required to provide legal advice and to prepare proposed ordinances ONLY when requested by the Council or its members.

The Attorney General's office found no requirement in the Charter that the Law (Legal) Department be the exclusive source for legal advice to the Council or for the preparation of proposed ordinances and no requirement in the Charter that legal document(s) submitted to the Council be reviewed only by the Law Department.

The coup de grace was the ruling that the special counsel could serve on a continuing basis and it is within the sole province of the City Council to determine the necessity of special counsel and the duration of his employment.

Cynthia Jordan not only erred in alleging an illegal action by the council but also erred in concluding that the Mayor has the right under the charter to veto the ordinance. There is a specific prohibition in the charter against the Mayor exercising a veto in regards to council staff appointments.

Therefore, we should expect Cynthia Jordan to be as blatant in her announcement of an apology to the council as she has been in screaming "illegal". Also, she should be as blatant in her announcement that the Mayor violated the Charter and committed an "illegal" act should he wrongfully exercise a veto of the ordinance.

Otherwise, her lack of remorse and failure to call out the mayor will underscore the paper's lack of journalistic integrity and focus attention on the true culprit putting the brakes on progress in Alexandria - the Town Talk.

The authorized council staff consists of two positions:the clerk and the deputy clerk. Of course the mayor can veto an ordinance for a professional services contract.
An attorney generals opinion is not considered a legal authority and that position was subsequently overturned in the Roy vs. Humphries decision.

If the council pursues a course against the specific advice and direction of its lawyer and the result is protracted and expensive litigation, can they be held personally responsible for the expenses occasioned by their breach of duty???

I actually laughed out loud when I read this. I cannot tell you of the number of people in town that have said they got a Beard sign in their yard one night because all they could figure was:

1) They went to Calvary or
2) The person that owned the house before them went to Calvary

I have seen several locations where a Beard sign has been replaced by another candidate, or a Beard sign and another cand. sign in the same yard.

I have actually stood next to a guy who got a call on his cell from one of the Beard boys who proceeded to berate the man because he had a Maxwell sign. Beard lost a few more votes that day.

But the event that takes the cake is Beard showing up at the radio trying to force himself onto a paid political program. Now that was just embarassing, and the Town Talk did a great job in getting that message out there while not fully publishing all the embarassing things Beard had to say that day.

And as far as Roy being a non-factor its hard to tell. The Repubs are seeing a strong surge in the polls in all races. Many races will be over in the primary. Because of the crap going on in the city, Roy is probably running 3rd thanks to his brother, but Beard is doing all he can to screw that up.

That's why you get so many juvenile posts on here about Maxwell, they are childish enough to think they are swaying votes with these antics.

And as far as money is concerned. The candidates own public disclosure filed reports tell the tale.

Maybe it's news to you that in both pres. elections (that were very close nationally), the repub candidates received at, or above 60% in every race in this district. Even Dewitt himself has said a repub would win his seat the next time out.

It is the reason that the state party has targeted this district as a pick-up. Any repub in the race will get close to 50% of the votes, just by being repub. Maxwell is getting a bigger boost because of a church of 3,000 members.

This type of demographic is why Nagin won re-election. Although no one can understand it, the numbers were there and he won.

Oh, I forgot to add, that's another reason that Roy is running 3rd. Roy's financial support of the Kerry and John Edwards campaigns doesn't sit very well with the conservative voters in the district.

Beard is only ahead of him because no one knows where Beard stands, however, his son's rumored antics and past troubles haven't help dad gain any momentum.

It seems that WeSawThat has split the sheets with Mr. Aymond. Their once cozy relationship seems to be cooling. Perhaps WST has realized what we all know…Aymond is a blowhard.

WST posted the complete transcripts from Aymond’s latest court appearance on his site. If you read the actual transcripts, you come away with a completely different picture of what happened in court than we were told by Aymond. Aymond got his clock cleaned by both Judge Swent and Jimmy Faircloth. Also, by reading the transcripts, we see that the Town Talk was really scraping the bottom of the barrel when it hired Karina Donica, This poor girl can barely speak English and obviously is totally lost in an American courtroom. Inept, doesn’t begin to describe her reporting of this issue.

As to the Pineville E-mail case, I have read everything. However, in my post I was specifically addressing your bungled court appearance of August 13. You attempted to have Judge Swent certify a partial judgment as a final judgment so you could appeal. The only tiny victory you took away from that court encounter was to have Swent certify your right to appeal punitive damages and attorney fees. This does not mean you will get them, you just have the right to now beg the third circuit for them. Swent denied them, and she is a lot easier to convince than the third circuit will be.

On each other point you argued, Swent denied you. Please tell us Aymond…where is your great victory?

Bottom line is, now you will be forced to file a supervisory writ, and I’ll wager that that writ is turned away.

I invite the readers of this blog to go to WST’s site and read for yourself. After a careful reading, decide for yourself if Aymond has misled you.

Perhaps you, yourself, should attend a reading comprehension course. If you would take the time to actually read what I wrote, I suggested an interpersonal communication course for the Mayor and the City Attorney so they could learn to speak to someone, with someone and not AT someone. I also recommended a class for the Council. You see, I realize there is a problem on both sides of the boat, perhaps that is why, as the Daily Fish Wrap has suggested, we are going nowhere fast these days.

Trey is a yes man, the Mayor can't talk to people and Chucks is out of his League as the City attorney. Now I ask how many people would take legal advise from this group.

Not a fair assessment. The council loved and respected Gist's opinion until he was unable to tell them what they wanted to hear.

If Scott says to the council what he has publicly said about the council, they are not going to be very happy for very long. Tony Martin has no experience, no skill, and very little talent. She is hired strictly because she is black. But Scott was hired because, among other things, he is soooo white.

How do lawyers decide things are legal or illegal? Isn't it just kinda their opinion or intrepretation? So if an Attorney General's Opinion is just an opinion and not a legal decision does that mean the COA lawyers opinions constitute a legal decision?

Does Aymond's opinion, the Town Talk's opinion and Cindy Jordan's opinion constitute a legal decision?

Why not settle the issue in court and see what THE LAW really is.

Gee what ever happened to the concept of Seperation of Powers. Gee whatever happened to independent Branches of Government.

Gee if it is so that all Attorneys hired by the City work for the City Attorney who reports to the head of the Executive Branch this means Trey is unbaised. Gee one could think Trey feels he needs to suck up to the Administration because they are his boss.

I thought if a lawsuit was brought against individual council members the Councilman was responsible for paying his own legal fees unless proven innocent. So how can we be wasting tax payer dollars unless the poster feels the Council will win and their legal fees will have to be reimbursed?

If a lawsuit is filed against say a person working in Electrical Distribution, City Attorney Office, Purchasing or Data processing do they have to pay their own legal fees or just the Councilmen?

I find it almost comical that the Alexandria city council refuses to take legal advice from an obviously capable attorney (Chuck Johnson) that the citizens see fit to fund as an appointed position by our mayor (Jacques Roy) who has proven to be a capable attorney advised by a chief of staff (Kay Michiels) who is also a very capable attorney complimented with the opinion of Mr. Trey Gist, who is also an attorney of note.
The ludicrous part of this whole scenario is that it appears that 50 attorneys could not instill an ounce of common sense in the members of the city council that are drunken with their self import while using our tax money to further their stupor.

It is one thing to not know.

It is quite another to walk into the path of an oncoming train while a large crown is warning you of your impending fate.

It also appears the citizens will once again have to deal with the gory aftermath of a few men's vanity.

And it would be funny, except for the fact that once again, Alexandria appears to be guided by a confederacy of dunces while the citizens and the folks that trade in our fair town pay the admission to this ongoing tragic comedy.

The Councilmen are the elected (read choice) of the citizens. Those that trade in this fair city who are not citizens have no say in the govenance of the City.

It should be extremely obvious that the Whites and Blacks financially able to have left this City. Elderly no longer feel safe and secure in this city (want proof wath the "racial bullying at the mall.) Check the crime rate in the mall parking lot especially the folks oreying on the elderly.

It should be extremly obvious from such events as Caplan's and Weis & Goldring deserting the mall the intelligent businessmen are training to protect and keep their business customers.

Alexandria will shortly resemble the 9th Ward of NOLA with just the White's left that cannot afford to escape. Throw into the miux Mr. Race Baiter Aymond and it becomes a hell of a deal.

Speaking of Coucil actions. Watch the back door action by one Councilman Joe Bishop of Pineville. Inside word has it that the Judicial Proceedings set for the 25th will somehow mysteriously disappear as will the criminal case. Isnt it a great country where some elected officials can get special treatment and the rest of us have to live by the law are be faced with prosecution. Stay tuned and watch.

The charter outlines the roles, duties, and obligations of each branch. The executive must not let the legislative usurp any of it's authority and vice-versa. The problem is, that under the Randolph administration, the council assumed executive like power and Randolph let them. Now Roy is determined to assume his proper, charter dictated role in the operation of this city. If he has to go to court to get it...so be it. In the end, the council will be forced to follow the dictates of the charter, like it or not.

There are some of us, while being accused of fomenting negativity, truly love Alexandria as our home and intend to see that it rises to a better place to live. That goal cannot be accomplished by fleeing everytime there is conflict.
I have personally chosen to fight the good fight to improve this town for my children and grandchildren and it looks as thought he battle lines are being drawn. That has been my purpose to this point in time. To awaken citizens to what is occurring in their city, in their name, with their money and not necessarily in their interest.

The first thing that citizens need to do is open their eyes and ears and minds to what is being done in their name for special interests. City business is taken care of for the common good, not to enrich the few.

Fast Track is a prime example of a fast one being pulled on the citizens.

Capricious zoning changes are another.

Copious studies that do not result in action or addition to a master plan for the city are another.

Transfer of public property without the benefit of proper procedure and citizen input are another.

Building new subdivisions marginally complying with city regulations prior to requesting incorporation are another.

Awarding contracts without full compliance of the state bid laws is another.

Allowing our police department to go undermannned and underfunded for enough years to cause blighted areas due to crime increase is another.

Allowing our fire department to suffer improper maintenence to equipment and failure to fund minor needs and repairs properly is another.

Allowing our streets and utilities to slowly deteriorate from lack of maintenence is another.

Poor overall planning is another.

While these items can be viewed as negative commentary, they each have an inverse approach that is not more costly in the grand analysis of doing the right thing for our city.

This is the crux of the matter. We have a city council that claims leadership, desires the power to impose, and has demonstrated the that it does not have the ability to priortize the needs and assetts of our community to make Alexandria attractive to retain our most precious resource, our progeny.

If our community is growing, how come our population statistics don't show it? Could it be that our council has no grasp of reality at the least and downright lies at the worst?

And their defense to any criticism of such glaring shortcomings is that the folks that speak out are racist. I would ask how they know?
Do they have contact with their detractors or seek them out to have a conversation or discover the depth of their character?

No.

That would require effort and sound judgement.

I would say to the majority racial component of our population, look around and ask yourself if you feel your business has been properly cared for.

Do you feel safe?

Are you riding on smooth streets?

Are your utilities affordable?

Do you see a rise in fire damaged houses in your community?

Do you feel that overall your business has been taken care of?

It is time for the majority to speak up.

I for one would like some examples of several claims he has made -

When was public property transferred and no comment was allowed?

What subdivisions were developed marginally and then incorporated?

If you're going to toss stones, show examples.
