Congratulations AG Foti?

Hmm, do we thank AG Foti for doing his job or wonder if there was another reason for his decision? I have thought for awhile on this perplexity. One wonders with the Landreau - Foti ties, that the "decision" of the AG was geared more by politics than law. Mitch's slate was cleaned in the New Orleans Mayor's race, the traditional Landreau political base. Mary, it seems will be in a real political battle for her office, hence her recent attempted retreat into conservatism. Charlie's (Foti) recent identification by James Carville as unable to spell "law" even if "he was given the L and the A". Could this all add up to an all out attack on Louisiana old line politicians? Perhaps Foti's decision was based more on a "heads down" mentality rather than law. I think I will name this the Shhh affect -- political camoflage. Why ring the doorbell and let people know your at the door when you can just walk in without drawing attention to yourself? My opinion: AG Foti's decision was based on not stirring up the population for the upcoming election cycle rather than upholding the law. The question at this point is his office. Will Louisianians consider him non commital or ineffectual? Either way he loses.

This is the same newspaper that was used by Fields and Dupree to attack Judge Philip Terrel so its not a surprise that its being used to slant any story against this guy. Northside Journal is routinely used by Fields/Dupree/Martin to attack their opponents. Sad thing for them is that nobody reads it. Ask the guy at the Chevron in Pineville he will tell you that they rarely EVER sell any and that there are always copies left in the rack. So, it might make the Triumverant of Pineville feel better but the real story about the hocuspocus that has been going on in Pville is being told elsewhere.

Yes, to refresh your memory, the Northside Journal was given the story of sexual harassment by the, then, clerk of court, Les Prestige, while Judge Terrell was out of town at a judicial conference and before he was advised of the allegations. Additionally, the Pineville administration obtained witness statements and sought the victims to file complaints with Pineville City Hall, even though they were employees of the Court, not the City.
Once Judge Terrell returned to town, he immediately had the Provosty law firm investigate the complaints, during which time ole Les was suspended. Once the investigation was completed, and the findings were presented to Les, he resigned.
This was simply Pineville's blatant attempt to use that unfortunate event to attack a popularly elected judge, who had nothing to do with the harassment and did the right thing once he learned of it.
The Pineville administration, with its ill-fated costly public records suit, its reversal of what it promised the voters as to their stance on alcohol sales, holding a press conference to tell people exactly how to file suit to get alcohol in Pineville, and Dupree's shady deals with LC and the Aces makes those people seem more about creating a false public smoke screen, that actually doing what is right. They also seem very paranoid.

It's not there because, it's not true. Even Aymond said that himself on this very blog!!

The article makes the following points:

1) Aymond will have to pay if he wants e-mails
2) Pineville will not have to release the e-mails in electronic form
3) Pineville gets to decide those e-mails which are public as determined by a “low level employee”
4) Pineville gets 60 days to separate the e-mails.
5) Pineville will not pay court costs and attorney fees
6) Pineville will be paid to deliver documents, sight unseen, or Aymond will have to withdraw his request.

Which points are not accurate?

I really don't see how that's a loss for Pineville. They, by law, had to produce the emails sought, they just didn't want to do it for free. And they didn't want Aymond sifting through them.

Now they don't have to do either.

Pineville sued Aymond seeking:

1). That the court set the parameters of his request;

2). That Aymond be ordered to post a bond, in advance.

Pineville lost both of those requests. Now do you understand?

You're half right.

Point #1: The parameters for release of the e-mails differed quite a bit. Aymond wanted ALL the e-mails, Pineville wanted to give him only the e-mails that did not contain sensitive info. Pineville now gets to separate the e-mails as to what is sensitive and what is not...and they get to make that determination, not Aymond. So, in effect, Pineville gets to choose what Aymond gets to see.

Point #2: You're correct, Aymond does NOT have to post a bond to pay for the separation and copying of the e-mails. He just has to pay the bill afterward, and those charges are already set in state law.

#1. Pineville cannot pick and choose what to release, as they must follow the Public Records law. The law provides what is a public record and what is excluded. Aymond asked for "public records", that would mean that he never asked for non-public records. There were no arguments over what is public or not, at the trial, as Pineville hadn't even reviewed the emails yet.

#2. No, you are being dense again. The LAW allows an agency to charge copy fees for public records. That is all Pineville will be allowed to charge. It will not be able to charge the $95.00 per hour it sought in its lawsuit.

It is amazing that Pineville is still trying to spin this as a victory, and yet it lost everything. I have actually seen the pleadings, and I am shocked to see the falsities being spread even after the judge has ruled. It is very sad to see the extent which peple will go to to make Pineville look good. The truth is that neither side got what they wanted from Judge Swent.

Additionally, if Aymond desires, the City of Pineville must make available to him a place to view the public documents at no cost. The only cost involved in obtaining public records is the cost for reproduction. You can sit and read them all day long making notes. Copies cost.

Once again, let me clear the air on this. Neither side got what they asked for from Judge Swent. Either side still has plenty of time to appeal.
Judge Swent's ruling did not contemplate the law, in that one is not required to obtain copies, and may clearly, by law, elect to simply view the records.
Lastly, if a previous poster alleges that he was in court, then he must be an employee or official with Pineville. Besides Bill Sumrall, of the Town Talk, one of my two clients in this case, and two other clients of mine, and the court staff, all else were Pinevillians.
It is one thing to inform people what is going on in that litigation, but Pineville should be embarrassed at trying misstate facts after the judgment has been rendered. Additionally, I have been outspoken on these facts and sign my name to my posts. The Pineville bunch is living in a dream world if they actually believe that I am the only one that reports Pineville negatives. Believe it or not, many others do not agree with many actions taken by the Pineville administration. They also post on this and other blogs.
The Pineville administration reminds me of the "Emperors New Clothes". They are the only ones who believe that they are perfect and well liked by all of their votes.

It isn't that dayum difficult to understand. A citizen of mature age has the right of access to view public records. What are Public Records is the deciding factor as defined by law not some bull shit decision exercised by a low level clerk.

After the low level clerk has reviewed the enormous number of records and deemed which ones are public records Aymond can sit down, go through them and ask for copies of all, several, none or a few depending upon what Aymond wants.

Mayor of Pineville tells the Town Talk that he didn't go to the Court hearing on Friday about the alcohol issue and didn't go to the Senate meeting on the issue either even though he was IN Baton Rouge. Its a disgrace that our Mayor can go to Baton Rouge for days on end to attend the Black Mayors Conference or a Municipal meeting but can not take the time to even go and observe a hearing on the Alcohol issue that would effect his very own City. Fields says that he 'wants the people to decide" yet forgets that they already decided in the last election on the matter. The Sabine case takes away the vote of the people. Why is missing work in Pineville and spending time in attendance at the LMA or the Black Mayors Conference more imporant than serving the citizens and representing the people of Pineville. The very same people who elected him on a promise of oppossing alcohol hales. The very same peopel he has lied to.
According to the Saturday Town Talk Fields spent the whole day Friday in Court observing a trial on a suit that the City filed against a citizen who requested public records. Isn't it interesting that he will take time away from the office to oppose freedom of information to the public yet won't take the time to represent them . This is not an alcohol issue this is a leadership issue and its a disgrace. You started this mess Clarence Fields at least be man enough to stand up one way or another and quit hiding and avoiding the responsibilities of your office. Recall in the works. Might not succeed but it might at least for moment make him honest or help him wake up and look around at where his "help" has taken him.

I think the magic is gone. Those that thought they could ride Fields fleating popularity to higher office have already found out that the dream is over. Kevin Dorn was going to be a star and run for State Representative on the coattails of Fields. But when it became obvious that Fields could not help him and that any campaign would only bring up issues harmful to Fields it was decided that Dorn won't run. Same for Joe Bishop who was all but elected to the Police Jury. So what is the lesson from all of this? Political cowardice has its consequences. What a difference a few months can make.

We are still trying to figure out why all but two buildings in our apartment complex got their lights turned on by 9pm Tuesday night, but yet our two buildings were off until the next morning, for a total of about 12 hours. Some interesting information emerged from last night's meeting held to present Christus St. Frances Cabrini Hospital's proposal to buy a portion of Alexandria's City Park. If anyone recalls, Cabrini attempted tp purchase this property several years ago. A ground swell of public oppostion stopped that plan cold. Why did Cabrini want the property then? Because it was running out of space for expansion. So recently, when the Aiken School property was up for auction, did Cabrini submit a bid? Amazingly enough, the hospital did not! And why not? Well according to Mr. Stephen Wright, Cabrini's spokesperson last night, the hospital knew some of it's staff doctors wanted to purcahse the property to build their clinic. So the hospital, being such a kind employer and so concerned about it's staff's own personal plans, deferred to those doctors' plans and passed on the opportunity to purchase that large tract of land that was next to Cabrini property. Later in the evening, Mr. explained that at the time of the Aiken property sale, Cabrini did not have the money to buy the Aiken property. Yet now, only two or three years later, the hospital is planning an $85 million dollar expansion. Quiet a change in financial circumstances in just two or three years! As part of Cabrini's presentation, Mr. Wright showed the hospital's plans for developing the area it wishes to purchase from the city. Those in attendance were treated to a wonderful description of a park-like setting with just one building, lush landscaped parking areas, a jogging path and a plan to save those great oak tress surrounding the tract. Yes, it sounded wonderful! But then, after some pointed questions, Mr. Wright admitted that the hospital planned to eventually build three building on the site. Did the hospital intend to decieve us with the plan showing only one building? When those three buildings are completed and all that wonderful parking space removed, will Cabrini want to buy even more of City Park? People, Cabrini Hospital has more options to expand if it would be willing to pay a fair price for property. The City of Alexandria has very limited options to replace any area lost from City Park. Could Cabrini afford to buy property other than the park property? Probably! Could the City of Alexandria afford to buy any property adjoining City Park to replace any tract sold to Cabrini? Probably not! When several questions were asked about Cabrini building another parking carage, Mr. Wright explained that people are reluctant to use parking garages. I would think that if that were the only parking available, people would be willing to use the garages. Several comments were made that Cabrini could build vertically rather than horizontally. The new surgery center is only a single story. What a waste of space! Finally, one member of the audience asked Mr. Wright what other options had the hospital explored in case it could not purcahse the city property. His reply was that the hospital had not explored any others. I hope the citizens of Alexandria will demand that Cabrini will fully explore all posible options before we sell off such a wonderfull asset as even a small part of our City Park.

you have captured my sentiments to the tee on the Cabrini issue. The property they covet cannot be replace for any price as nothing else would be contiguous to the park complex. In the future event that our city population expands and the zoo needs to expand, we will be experiencing the very same problem that Cabrini says it is experiencing. I am even more deeply troubled by the fact that the city has entertained the conversation in the first place. The Rapides General debacle still stands out as a masterful deception of our citizens as well as an illegally prosecuted sale. Let there be no more.

I also found it most interesting that news coverage appeared to be biased in favor to Cabrini as the reporting centered around Cabrini's expansion plans and needs as if they were somehow entitled to do so at public expense and that the cit(y)izens should roll over to their request and be grateful for the conquest since Cabrini is such a large employer. Where was the mention of citizen concerns and objections?Could it be that the sizable expenditure of advertising dollars to both print and television have affected media objectivity? Just asking.

Here is possibly a viable solution, which would open more opportunities for expansion @ SFCH...
Build a parking garage (of 4 to 6 floors) atop of say another 4 to 6 floors of medical office/treatment space upon the parking lot across Masonic Dr from SFCH (in the old Salley's Grocery Store). Simultaneously construct a skywalk (moving sidewalk type like in some airports) across Masonic Dr which will eliminate the liklihood of pedestrian splatter for those needing to enter the hospital proper (aging population). Additionally, the parking lot area behind the Emergency Dept entrance could be expanded "up" also and in fact attached or not to the current parking garage.

By the way, I have no "interest" in these projects other than just seeing common sense in play for all involved...

To "let them buy it" is a very short-ighted, one-time event that shows no knowledge of real estate basics or fiscal management ability. Whatever price is recieved today will be insufficient to replace the same acreage tomorrow. And the basic 3 tenets of real estate, location, location, and location cannnot be duplicated with any other site as far as the city interest is concerned. I'll trade you a nickel for a dollar any day.

There are other tracts adjacent to the hosp. that would serve their purpose as well but they are not currently for sale either. I wonder what made them think the park tract was? At any rate, part of the cost of their proposed expansion is the purchase cost associated with purchasing those tracts along Prescott. Another curious observation stems from the fact that they had all these plans and charts and mock-ups prepared yet never even considered an alternate solution. They are bound to think that its a done deal, despite what our mayor says. That makes my ass "blossom".

For the most part, Jacques is surrounded by the same blue-haired ass kissers that made Ned's decisions There are some vocal historic preservationists who are good folks but can not see beyond their own narrow objectives. If harry and myron believe so strongly in downtown why do business from there?

I really don't think Jacques is listening. He got 76% of the vote and has started a new religion. He fails to understand that he rode a strong negative reaction to Brewer's antics and really really bad campaign advice. Your mail: Road repairs should come first

The citizens of Pineville should be outraged at our elected officials for their irresponsibility in upgrading the infrastructure of the city. Try this on for size: take a little drive down Donahue Ferry, Hollymoore, Pinehurst, Susek and Stilley roads and, should you survive the drive, thank the good Lord because your elected officials had nothing to do with it. I know Susek is on the drawing board to be upgraded in the future, but these roads should have been upgraded years and years ago.

The city has allowed unabated growth to take place in these areas making the situation even worse. What is the sense in having a nice home in a nice subdivision if you run a high risk of being killed on bad roads getting to it. As I write this the city continues to allow a new private school on Donahue, another huge subdivision across from the ball complex and even another huge subdivision across Highway 28 East at Pinehurst and they are still building on Susek and off Stilley Road. These are essential roads through our city and all are overcrowded and potentially death traps.


ADVERTISEMENT

We're getting the cart before the horse when we should do the infrastructure repairs and upgrades and then the subdivisions. Developers and builders don't care. But they should not be granted permits to develop if the infrastructure isn't there to support the project.

They're making big money on these developments, and the taxpayers are footing the bill for the upgrades (when they are done). Make the developers and builders pay if they want to build, and let's hold our elected officials responsible for issuing these permits.
There should not be another building permit issued in this town until our roads are upgraded. Having the highest sales tax in the state tells me we should have pretty near the best of everything, including good roads.

The Secret is that HE has neither the plan nor the vision and certainly NOT the smarts to have a plan. He is about handing out checks for the camera, glad handing and taking credit for the growth. What activty the City does do comes from suggestions from City Engineer Tom David who has self interest in doing the projects. However, there is ONE road that the City does have a plan for. Which on do you ask? The one that leads up to HIS house. Thats right. There are streets all over your City who are in bad shape but what does he do? He takes a road which is owned by the PARISH not even in the City and gotten the City aldermen to vote to bring it into the City so that he will have a good road to his house. Is that the kind of self serving vision you want for your City? BUT WAIT. You have done the ONly thing that gets things done in Pineville. You have shown the light on their ineptness . Count on some action now. Is it not a shame?

What a DUMBASS! The BIG SECRET here is there are a few hate-filled posters, who try to make Clarence Fields look bad because he doesn't share their way of thinking.

I have lived on Susek Drive for 15-years and the talk of fixing Susek Drive began under Fred Baden's watch. However, only last year did the first piece of right-of-way get puchased from us. Finally some movement for someone who you say "has no vision".

Secondly, Mr. Scott referred to roads in need of repair that only parts of, are even in the city limits (Stilley, Hollymore and even Pinehurst), yet he wants to blame the City of Pineville for not "making developers pay to build"...when in fact, many of these subdivisions develop around roads that are already there and some are not even in the city limits.

Third, the BIG SECRET here is that someone on this blog has posted that Pineville has taken in a road (Pinehurst Drive) that leads to the Mayor's house...BULLSHIT! Prove where that has ever happened in a public meeting or anywhere. Pinehurst Drive continues to be a road in need of repair, but it is still a road shared by the Police Jury, The State of LA. and the City of Pineville. I know because I have complained to ALL OF THEM!

So try looking through something other than your hate-filled glasses. The only BIG SECRET here is that your smear campaign is just that, and you can't blame him for no vision and then smack him with too much development. That's pretty INEPT!

Over the years I have found one thing to be true about the people who live in Pineville. They fall into two groups. Those who cling to the good old days when Fred Baden ruled over city hall and the city employees were free to use city gasoline in their personal vehicles, sell city property for cash, shake down business owners for "donations" and basically run the city as their own little mafia territory.

Then there is the other group, who got tired of the Badenites, and ran them off from city hall.

Since then the Badenites have lurked in the shadows, fearing the sunlight that might lead to an indictment of their past behavior. They feed on dis-content and try to do what ever they can to get back into power while hiding safely behind the nearest rock. They whisper lies in an attempt to drag down whatever administration occupies city hall. They did it with Deslatte, they do it with Fields, and they will target the next mayor...unless the city falls back into their hands. Then the corruption will begin anew.

They are liars, thieves, and political wannabes who covet power above all else.

Anyone who believes their propaganda, is a fool.

Ahh so you are a little Fields and gang Nazi. Face the facts, Fields getting called upon to answer for his acts has absolutely nothing to do with Baden. When will the present Pineville administration start taking responsibility for their actions instead of attacking anyone who disagrees with them?
The Fields administration is nothing but hype and smoke screens, and they don't like it that people are starting to see through that.

Well let me step in an I'll be you huckleberry. I am also one of those that think there are many things wrong with Pineville's administration, and have often proven it. I have no dog in the hunt over who your mayor is, Fields or Baden, but whomever it is I expect him and his staff to abide by the law and not cause harm to my clients.
And by the way, Anon May 21, 2007 7:20:00 AM, I don't recall seeing you posting your name either. Mighty big talk, but no name.
