Breaux for Governor?

I fail to see why he can even consider the possibility? I am not an attorney and ask for an insiteful discourse here folks.


Residency is the issue here. In order for Mr. Breaux to "qualify" he must be a citizen of the state of Louisiana. He has a Maryland drivers license and is registered to vote there. So his LEGAL residence is in Maryland. He has to spend a day more than half the year to qualify for this residency. Therefore he IS a citizen of Maryland, not Louisiana. If he wants to return to Louisiana to help in it's recovery he can move his office here and by office I mean private sector. He is not qualified to run for any office in Louisiana ... if he wants to be Governor he can run in Maryland. If he wants to be Governor of Louisiana, he can move back and run in 2012.

There is also something called the "fair use" policy, that allows copying part of a work for praise or criticism purposes.

The language used by Congress in Title 17, Section 107 specifically lists “criticism, comment, news reporting, teaching, scholarship, and research” as examples of uses that might be protected under fair use.

If your use is fair, it is not an infringement of copyright -- even if it is without the authorization of the copyright holder. Indeed, fair use is especially important to protect uses a copyright holder would not approve, such as criticism or parodies. See Campbell v. Acuff-Rose Music, 510 US 569 (1994).

In the March 23, 2007 edition of the Town Talk, former Judge, Ross
Foote, attempted to rebut a critical opinion of Foote's baby known
as "collaberative divorce". The critical opinion of that type of
divorce, was written by Susan Ford Fiser. Susan, who has probably
handled more divorces this past year than Ross Foote has in his entire
career, correctly debunked Ross's colleteral divorce propoganda, as
being a costly and unrealistic approach to divorce for the majority of
working class people. Ross, however, has travelled around promoting
his "collaberative divorce" ideas, no doubt with speaking fees, tax
deductions and other perks. In fact, Ross wrote in his Town Talk
article that "After 13-plus years as a judge, handling more than 1,500
divorce cases, I retired to promote what was clearly a less
destructive alternative to the lawyer-driven divorce."
Do you want to know the real reason Ross left the bench? In a child
support case, handled by Wilbert Saucier, Wilbert claims that Ross was
caught cancelling lawfully served subpoenas, served by Wilbert on the
father of his client's son, who happened to be the son a friend of
Ross. When Wilbert discovered Ross's imporper interferrence in that
case, and was preparing to file a complaint with the Judiciary
Committee, all of the sudden Ross up and resigned his judgship.
We all make mistakes, and should be forgiven. However, the first
step to forgiveness is admitting the wrongdoing. Ross failed to do
that. So when reading what Ross says about "collaberative divorce",
think of his credibility, lack of understanding of the common man, and
his biased motives in such a discussion. Re-read Susan's article, to
get the real scoop on the folly known as collaberative divorce.
Judges are not Gods, and they are supposed to be public servants.

Today's dollars, yesterday's dollars? Would the expansion for WWII equal the expansion of today? Would the wartime expenditure of WWII for manpower, material, lend lease, (in today's dollars) not exceed Bush's expenditures.

Bridgett Brown this week in U.S. District Court contested her dismissal in the Alexandria-Cleco Corp. case and wants the city to honor the contract she signed in 2005 for 10 percent of Cleco awards.

In papers filed Monday, she asks Judge Dee Drell to let her intervene in the dispute.
Asked for comment Wednesday morning, Brown referred questions to her attorney, Larry English of Shreveport.

English in court papers and in a telephone interview Wednesday stated that the City Council approved Brown’s contract in July of 2005, and that it is the legislative body she answers to and works for, not the executive branch.

City Attorney Charles “Chuck” Johnson, who works for Mayor Jacques Roy, discontinued Brown’s involvement via a letter in February. At stake is the 10 percent stated in her contract that Brown was to receive if Cleco is found to owe Alexandria money.
In the termination letter to Brown, Johnson cited professional conduct rules in stating that Brown had harmed her client, the city of Alexandria.

“A lawyer shall not use information relating to representation of a client to the disadvantage of the client unless the client gives informed consent,” Johnson wrote.

Johnson did not elaborate on how Brown had disadvantaged the city, and did not return a call for comment Wednesday.

But in a letter to the council and Roy dated March 6 and faxed to The Town Talk on Wednesday, Brown states it was because she answered questions posed to her by the council.

“How possibly can attorney Brown be found guilty of an ethical violation by stating to the body that hired her it has the ultimate authority to hire special counsel?” English stated.

Brown and English also stated that Roy could have ethical problems in his current role as one of the negotiators in the ongoing mediation with Cleco -- a conflict the mayor denies.

Alexandria and Cleco officials participated in mediation talks in Lake Charles on Sunday and Monday.

Roy and a team of attorneys, the council and other city executives were present at the Lake Charles mediation, with the mayor taking a lead role.

English states in the March 6 letter that because of Roy’s involvement in another case related to the city-Cleco dispute, he needs a waiver from the council to participate in the city’s case.

“If no such waiver exists, the mayor is bound by Louisiana rules of professional conduct to recuse himself from the case,” English states.

The mediation, which has federal court oversight and will continue for the next month, is an attempt at an expedited completion of the ongoing dispute, in which Alexandria contends its ratepayers were overcharged for years.

(A) The head of the legal division shall be the city attorney who shall be appointed by the mayor, subject to confirmation by the council, and shall serve at the pleasure of the mayor. He shall be an attorney licensed to practice in the courts of Louisiana with at least five (5) years' experience in the practice of law.
(B) The city attorney shall serve as chief legal adviser to the mayor, city council and all divisions or departments, offices and agencies, shall represent the city in all legal proceedings and shall perform any other duties prescribed by this charter or by ordinance.
(C) Any assistant city attorneys authorized by the city council shall be appointed by the city attorney and serve at his pleasure.
(D) No special legal counsel shall be employed by the city except by written contract and approval of the city council.

Seems simple to a non-lawyer. Also seems simple that BB, even though authorized and approved by the city council, serves at the pleasure of the city attorney.

Sec. 3-07. Powers and duties of the mayor.
The mayor shall be the chief executive officer of the city. He shall have the following powers and duties:
(1) Appoint and suspend or remove for just cause all city employees and appointive administrative officers provided for by or under this charter, except as otherwise provided by law, this charter, civil service or other personnel rules adopted pursuant to this charter. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to subordinates in that officer's division, department, office or agency.
(2) Direct and supervise the administration of all divisions, departments, offices and agencies of the city except as otherwise provided by this charter or by law.
(3) See that all laws, provisions of this charter and acts of the council, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed.
(4) Prepare and submit the annual budget and five (5) year capital program to the council.
(5) Submit to the council and make available to the public a complete report on the finances and administrative activities of the city as of the end of each fiscal year.
(6) Make such other reports as the council may reasonably request to enable the council to conduct its councilmanic function.
(7) Keep the council fully advised as to the financial condition and future needs of the city and make such recommendations to the council concerning the affairs of the city as he deems desirable.
(8) Perform such other duties as are specified in this charter or may be required by the council.

Was Mr. Despino caught off guard by the letter? I'm sure he was but in the grand scheme it doesn't matter.

From what I heard Razz, not once, but twice failed to correctly complete his bid paperwork. He completely controlled his own fate; he has no one to blame but himself.

The letter, although a gross clerical error, has no real weight. The state bid law appears to have been followed to a "t." Do not chastise these people for doing there job; after all, they just have to follow the law. No big deal right?

Roy should be proud to have employees on staff who have an attention to detail so things like the "cost share" debacle are not repeated.

If you are so sure there is a cover-up; make a public records request and show us all how you are smarter than a purchasing manager, two lawyers, and engineer put together.

Word on the street from those who seemed to know was that the rent was/is substantial (10-15K / mo)and is the vehicle for make cash transfers between the parties for services rendered. Bear in mind that $0.85 to 1.25 ft. is a moderate monthly rent range, so I am wondering what amount of square foootage they rent. There must be a basement because the first floor appears to be approximately 3000 sq ft. total that also houses the State Farm office.

I merly remarked on the ineptness of the trio in not even being aware of what they said in their own letter and then trying to BS the council. The bid should be totally rejected and rebid if Frankie's was informed it would be. that you will start suggesting to folks to take their business outside the area, because it obviously doesn't matter where one lives.

For example, tell teachers that support Breaux, that you will recommend home schooling or private school to parents.

Lawyers that support Breaux, tell them that you'll recommend people call Morris Bart (I think he's in BR)

Doctors that support Breaux, tell them that you'll recommend patients go to Houston.

Then why don't we start on a local level? Is Myron Lawson really renting out office space to the former city attorney Kelvin Sanders and the city's former Cleco attorney Bridgette Brown? If so, are they really paying an inflated rate?

Why is this just now coming out? Where has the media been on this? It should be easily provable. Is the media too afraid to ask the tough questions? Are they too close to the politicians they cover?

I'm not sure why anyone would be afraid of Myron Lawson. He barely won the last election over that strange doctor. If he really has financial and business arrangements with Sanders and Brown, then this needs to be immediately investigated.

First, you idiots, THEY (meaning all seven council men...for the red necks that do not understand) DO NOT TRUST Roy. Second, Roy has some serious problems with the Bar Association due to the fact that he "JUST RECENTLY" withdrew as counsel for Sam Samsing AND his ethical problems in his current role as one of the negotiators in the ongoing mediation with Cleco. Why wouldn't they attend and why the hell would they trust Roy and his team. If you red necks could divert some of that hatred away from Bridgett Brown and see whats really going on maybe, just maybe you can become a red neck and not a stupid ass red neck.

The administration deserves it. Lawyer English accused Chuck Johnson of trying to deny him his 5th amendment right of free speech. I am starting to live for alternate Tuesday evenings. I'm thinking that they need to rerun that ad of Brewers but they will need more than one brown pig at the trough.

There is no 5th Amendment Right of Freedom of Speech. That right is in the 1st Amendment. Obviously, he was mistaken. The 5th, on the otherhand, includes the famous "right to remain silent", which he and Ms. Brown should exercise more often.

This is no abstract legal issue. What we are talking about is what happens to our money. The counsel puts on this act like they give a shit about poor folks on fixed incomes and public assistance but they don't hesitate to take a couple million away from the people who paid the money out and are due the refund in favor of "somebody that looks like them". And that moron fowler is one of the driving forces. And you are probably right that Myron will get his cut thru rent.

Chuck Johnson was an assistant DA. You can be sure that he shared his experiences of Lawson with some of the folks up there. I guess getting re-elected is so important to Downs that he won't do his job.

I looked at some of these LLCs and what is interesting to me is how many of them are no longer in good standing. It's easy and simple to file a report to ensure the business remains in good standing, even if the business collapsed or was sold. The fact that many of these companies never filed annual reports should raise more than a few eyebrows. What information are they withholding? What is the need for this type of clerical negligence?

I, for one, am more than interested in seeing how to "silk stockings'" LLCs are directly tied to the city attorney, the city's Cleco attorney, and a city Councilman-at-Large... but I doubt you're going to find that.

It may be true that this type of shit happened in the past with other Councils, but that is no excuse for PRESENT unethical behavior.

I agree with what was said earlier... these people like to brag about how they're looking after people in low-income neighborhoods, but Kelvin and Myron seemed to have no problem giving their friend and office mate a financially lucrative appointment to a case she was hardly qualified to litigate.

It's already obvious Sanders had no problems with engaging in potentially unethical behavior when he landed his "wife" the housing authority contract. Hey, does anyone know who represents the housing authority as legal counsel????
