Once upon a time ...

And so most stories begin (or it was a cold, dark night ... but I am trying to look ahead here), Jacques has come out of the gates with a good start. The race however is a 4 year stretch. Will he change the face of Alexandria politics? Will it be better or worse?

Perhaps this blog might be used by the citizens of Alexandria to impart our wants and desires to our new adminstration. If you want investigations, ask for them here. If you want something brought to Alexandria ask here.

Why doesn't everyone on this blog say or do something positive on this thread? We can get back to the slaughterhouse next thread.

I think scarred is actually scarred because he thought Jacques was going to give him some big title position that has already been given to someone else. Perhaps he feels jolted by the loyalty he portrayed during the campaign - the long hours, the extra work, the standing by his/her man through thick and thin - only to be forgotten when it comes to actually performing the duties of Mayor. Perhaps scarred isn't qualified to do any position available at the City, but was a perfect mouthpiece during the campaign.

It appears that we continue to successfully occupy Irag after a victorious battle, albeit with some casualties - which is a natural penalty and occurance in war - where is the vanquishment?. I'm thinking that Scared may have had a yard sign and that's about the extent of it, however, Scared has been on the outside of life, looking in, and resenting the hell out of the achievers and now would like for Roy to be his avenging angel. You are quite cavalier in what you choose to call a "cost". I remember you mentioning that you have children of varying age - I assume none of them are in a position to become a "cost". Please tell me what our losing the war in Iraq (according to the new Sec. of Defense) is going to do for my freedom. Aw hell, tell me what winning the war (as if that were possible) will do for my freedom. (I predict that you will mention 9/11 to stir my emotions, as though that had ANYTHING to do with our ill-conceived war on Iraq).
The bad news is that you are probably going to have the chance to put your blood where your mouth is because there is a reasonable chance that you young son or daughter will become a "cost" of the middle east conflict. I understand that you and Mrs. Spanky get a folded flag. Seem worth it to you?

And if you are worried about our southern border (which we don't happen to share with Iraq) you better get your ass over there because we ain't got any available military assets for that or any other conflict. I assume, however, that you are talking about the ever useful "domino theory" that served us so well in Viet Nam. Lots of "costs" and folded flags there too.

Bush failed in Iraq on both grounds. Politicians should stick to making the decision to enter into war, and let the military wage it thereafter.

The reason our presence in Iraq is important is two-fold. Russia needs a warm water port to project naval power, something their continued struggle has yet to produce and the reason we can be globally successful. Two is the protection of oil shipping lanes for the continued supply of the western allies. Iran attempted to annex Iraq's oilfield and coastal ports in their last war. Our military presence in both Afghanistan and Iraq have us in a flank position on two fronts with Iran which directly relate to our national security interest in regard to oil supply and Russian naval harbors. My oldest son served in Afghanistan and eldest daughter in the army. As a child, I saw the Russian Peninsula of Sahkalin every day for three and a half years and their efforts on the Japanese mainland to be disruptive as well as their continued efforts to exert military force - Wakkanai,Japan is were the wreckage of Flight 007 washed up after a MIG attack. Threats to our security do exist. It appears you have the luxury of never have been in fear for your life through aggression, so you do not have an understanding how fleeting your security can be. I suggest you take a trip to Brownsville and Laredo and report to us how safe you feel then.

Newspaper says that Clarence is moving the City Counsel meeting to Pineville High so he can honor the football team . How ironic is that?His absence of support for the football team was noticed by all of the parents of the players and the pep squad the whole year. I wonder if he knows where Pineville High school even is? This would be yet another example of "Mayor Feelgood" trying to jump on the bandwagon of something good without having anything to do with it.

the town talk had the following item on their website yesterday; promising a followup story yet they havent posted one yet and even this page appears to have been scrubbed from the town talk website:

Mayor Roy to address city meter reading backlog today

Alexandria Mayor Jacques Roy will hold a press conference today concerning the city lagging behind in reading utility meters.

The press conference will be at 2 p.m. today in the mayor's office in City Hall. Check back on our Web site, www.thetowntalk.com, later today for a report about the press conference.

The city is three weeks behind in reading utility meters, creating a situation where customers will receive compounded bills right before Christmas, Gayle Jackson, head of the city's Utility Customer Service Office, said earlier this week.

While the city is budgeted for 11 meter readers, there only are three, Jackson said. The problem is those three each must read 15,000 meters in the city monthly.

Alexandria has contracted five other readers, but short-term solutions aren't going to fix the problem, she said. Poor wages have caused some meter readers to walk off the job.

Roy took office as mayor on Monday. At his first council meeting on Tuesday, Roy called the meter reading situation "unacceptable" and said the city must find a way to quickly fill the meter-reader vacancies.

to use other utility dept. employees to assist in meter reading until positions can be filled; talk to civil service about raising salaries to fill the position. Plan to waive late fees for this cycle. When you finally pay your bill you can go to the lovely downtown utility office to get pay your deposit to get your utilities cut back on.

The paper said they had 8 or 9 trainees for that job but the problem was turn-over. You got to offeer them more in salary and benefits that their crack distributorship. My water meter has been covered with mud and leaves for 2 years. So part of the job qualification is apparently Xray vision.

Is it their responsibility to clean your meter, or yours? People like you wonder why their bills are estimated, but do nothing to ensure that they can be billed correctly. I think that I will plant poison ivy by my electric meter, cover my water meter with mud, and chain a pit bull to my gas meter.

You are a little dense. The issue would seem to be are they reading the meter and if not, where are they getting the numbers on my bill. Most people do not inspect their meter or even know where it is. If they are making up numbers but pretending that they read the meter, that can be a problem in a number of respects but to start, it's just plain dishonest. Many folks I talk to leave their meter obscured just to be able to determine when, if ever, somebody actually does their job properly.

Your "not my job" mentality explains why you identify with the meter reader.

My electricity was estimated for the last two months due to the readers not going into my back yard because of the dog. I chain the dog on the days they tell me they will be by, but then they don't show on those days. This week I was home when they came by and they took an actual read. They were back two days later because the read was rejected showing negative consumption. I wonder if I will get a credit this month. I too question the accuracy of the "readings".

I get the impression that meter reader is an entry level job because the others in the dept. know how to read the meters and will temporarily be filling in. That suggests that they once read meters.

And in doing so you are breaking the law. The Code of Ordinances clearly states that meters must be accessible to the City at all times. If a meter reader can't get to your meter, his/her only recourse is to estimate hte reading. An estimate is just that a scientific guess based upon your consumption in prior months. Listen to the committee meeting testimony of Mr. Crutchfield. Estimates were down to 3%; 3% of 60,000 = 1,800 estimates. Not bad if you ask me.

The access they are talking about has to do with fences and hedges and pets. Normal debris covering the meter face doesn't interfere with reader access. I think it is there duty to read the meter or report some problem with them doing so. Meter readers read meters, even if they are city employees.

Wow, what high expectations you have. Right now, they have 4 meter readers to go to about 60,000 houses. Each house has at least 3 meters, gas, electric and water. and of course there is no standard location to find each meter. Each month has about 30 working days. There is no way these guys can keep up with all that they are expected to do. Plus, don't they also have to read the various meters at area businesses?

Hate to work for the sweat shop you work for. A month has approximately 21.+ work days.

I will try to explain this real simple because to a reader obscure is defined as acess.

There are 8 work hours in a work day, 5 work days in a week which equal 40 hours. There are 52 weeks in the year so 52 weeks times 40 work hours per week equal 2080 work hours in a year. 2080 work hours divide by 12 (months in the year) equals 173.333 work hours in a month. 173.333 work hours in a month divided by 8 work hours in a day equals 21.666 work days in a month.

Maybe this way will help more better. April, June, September and November have 30 days, all the rest have 31 except February and it depends on which time zone your in to determine how many days February has. (Has something to do with the efernal equimox and the mating habits of rabbits.)

So if the month has approximately 30 working days where do the weekends come from? I know Tinker Bell. Weekends are not real we are in co-planterium existance when we think we are fishing and such but we are really at work.

So if that doesn't obscure daylight savings time no possible access ever will and you will be in violation of an Alexandria ordinance (which could be a highly explosive situation.)

The first month you got an estimated bill you could have called and asked for them to come out and read your meter. A supervisor could have been sent out that day - especially if you thought the bill was high. The nice thing about the new bills is that it shows your current month's consumption, the previous month and the current month from a year ago. You can look yourself to see if something funny is going on with the readings. And if you go out to your meter and see that it doesn't match your estimated bill then you know something is wrong.

William Jefferson has been re-elected. Can I say that I am embarassed to be from Louisiana even though he doesn't represent me? Granted, the man is innocent until proven guilty, but the City of New Orleans has managed to re-elect Mayor who failed them during Katrina and now a Congressman who has used his political power to send funds to organizations that employ his friends and family members and is also under investigation. I guess this means Blanco will be re-elected at the pace we're going. This state will never get out of the shadow of Huey P and Edwin as long as voters fail to make intelligent decisions.

Roy says there are 15,000 meters to be read monthly. There are systems which are far less labor intensive and provide consumption data to a centralized computer. Sending men out in the heat and rain to pull up iron covers and read a meter is a 19th century solution. The telephone company doesn't have to come to your house and look on the bottem of your phone.

How much do you think these new systems would cost? Who do you think will fix them when, not if, they malfunction? How well do you think it will sit with the council when you eliminate 11 jobs for our citizens (black men) ? The only way they will switch to a new system is if one of their friends is the "consultant" or "contractor" or if they find someone who works, or did work in Myron's office.
Maybe as good citizens, we could just all call in and self-report.

How much training is needed to be a meter reader? How much does it pay? Sound like a job some high school students could do afterschool and cheaper.

It may be a figment, but I think I recall President Hobbs trying to get a "study" on self-reporting meters by some engineer firm friend of Myron's from Baton Rouge during the past six months. Seems like Billy Gunn shined a light on it and Ned stopped it. Those guys do love an expensive study. What ever happened to the red river water purification study? Remember. Some company could remove the turtle shit from the river water for about 3 dollars a gallon and we were going to sell it to some local manufacturer for about a nickel a gallon>>>>

My good citizen you are right an automated reading process would be great but the iniital implementation would be expensive - about $15 million to be exact.

Here's the quandry: Do you want the City to spend $15 million to make sure you recevive a perfectly timely and accurate utility bill or do you want them to spend that same $15 million on the aged infrastructure so that your water isn't brown, so that your lights burn, and so that the sewerage actually leaves your house?

It's not like we aren't spending loads of money right now on training, gathering, compiling, reviewing, and issuing utility bills. And we appear to be doing a piss-poor job of all of the above. Someone (certainly Mrs. Lawson or Myron's 12 year old son) needs to evaluate the long-term cost and efficiency of the two (or more) alternatives. The labor intensive method, particulary in government, is seldom the best method either logistically or economically. We obviously need an incredibly expensive and meaningless study by unqualified tenants or friends of Lawson, preferably from out of town.

The raw numbers suggest a 20 to 30 year payback on the installation costs when compared to the salaries that would be eliminated. 20 to 30 years in technological terms is a millineum.

There are few council meeting where a disgruntled utility customer, usually from the minority community, does not complain about billing errors that work tremendous hardship on families that are struggling already. Fowler, head of the util. committee, usually says "we are doing our best, sorry". It is a wonder that he makes it out of the chamber alive. The inconvenience of working out an incorrect utility bill is one thing but if you are deprived of life's basics because of it you have created or at least permitted a tremdous political and humanitarian problem.

The article clearly was written to expose something without saying what it really meant and that is that if you get a ticket or arrested in Pineville all you have to do is ask the powers that be for a favor and it will get dismissed or reduced. I bet that pisses the Police off. They put their lives at risk everytime they stop someone only to have this nerd in the paper reduce or dismiss it. I too would like to hear about what criminal cases actually are prosecuted in Pineville...if any.

If you get $600+ in social security and you get a utility bill for $375 instead of $130 the city's mistake is devastating to you. You will have to forego food or medicine to keep your lights and heat on. The fact that you can iron it out later is of very little immediate comfort.

Secondly, I don't pay the meter readers a cent. I pay the city taxes and fees and utility bills and charges and they decide how they spend it. The city is the one that tells me that they are going to provide utility services based on my ability to use or conserve utilities. They promise me that they are going to gage my usage for the previous month and bill me accordingly based on some formula that only they know. I can't go to the other utililty company because the city has the only game in town. These poor underpaid readers don't provide me with any services, the city does. The city decides what to pay these guys just like they decide what to pay the head of the GAEDA board or the studier of the water park or the chief of police.

Next to my house note, my utility bill is my biggest regular monthly obligation. I think I have a right to expect the city to make every effort to charge me and the poor old bastard on social security the right amount. The city's utility income keeps everything going.

I think I have a right to expect my utility bill to accurately reflect what I owe. I think I pay rather handsomely for that right. You see, I don't hire or pay the meter readers - I hire and pay they guys that hire and pay the meter readers. They are the ones that are screwing us over.

Goverment, including the City, needs to learn that there is no money tree out there. They must lean to live within a budget, like the rest of us, and learn that we cannot buy everything. In my opinion basic services, such as fire, police, water, sewerage and electricity come first. Performing arts centers, art museums, pretty bricks in downtown streets, golf courses and etc... come second. I think sufficient meter readers, paid a decent wage, is more important than some of the other art crap.

The city being behind on reading your meter does NOT affect you total payment. If you didn't get a bill for electricity in Novemeber, but in December you get a big bill, it is the same thing. Do people really NOT budget for utilities, and if I don't get a bill, I can just spend the money?? You lack of planning, and mananging your life should not be anyones fault but your own. If you get social security of $600 a month and you get an estimated bull of $125 which is $80 under the actual amount and the next month you get a bill for $230 which you either pay or get terminated and to get reinstated costs the arrearage plus a $150 deposit. It's not about budgeting, it's about survival.
The deal with the city is they tell you how much you owe and you pay. If they don't keep their deal but hold you to yours is that really fair.
Maybe the elderly black person on social security and diabetes and heart disease and arthritis and 14 prescriptions to fill every month can just go get the extra utility money out of his trust fund.
You have no brain and no heart. You make excuses for the city because you can manage and you don't give a flying shit for those who can't

Your last sentence is prophetic. Lots of people who felt secure and solvent have found themselves suddenly unemployed or displaced by a storm or with a family member with a horrible illness that requires more resources than they can muster and then, all of a sudden, you are them - the poor, the destitute, the desparate, and the memory of your lovely house and golf membership and expensive clothes and cars is just a painful recollection. First, the City doesn't decide how much the head of GAEDA makes - the GAEDA board does - if you don't like the fact he now makes $105,000 + benefits - call a board member and complain about it. What the hell does GAEDA do anyway besides hire consultants?

On the utility bills, Yes, the December bill might be higher. It's going to be high because you didn't have a bill in November. Now, did you happen to think in November - Hey I didn't get a bill and I know I should have so I should put some money aside. Maybe the same amount I paid in October so when the double bill comes in December I will have money to cover the bill???? NO, you went and spent it anyway.

As for an elderly person - black or white - who is on 14 medications and fixed income. If they are already not signed up, they need to be signed up on the reduced medication program - MCAP I believe is the acronym. They can also enroll in programs the manufacturers have to assist with lowering the costs of their medications. They can also discuss with their doctors if generics are available which are a cheaper route as well.

These same elderly people are more than likely living in a home that could use additional insulation and weatherization programs to assist in lowering their utility costs. These are programs the City, along with other non-profits need to begin to look at and start targeting neighborhoods and homes with grant programs. HUD actually has programs for this.

3:55 when your employer pulls out of town or your job is outsourced and you find yourself unable to make the wages you are now, please don't come back on this blog and whine. Every person in this City, unless you are employed by the government is subject at any point in time to job loss. Katrina and Rita should have shown that in a moment everything you hold dear - your home, your memories, your things, can all be taken away - even members of your family. Most families don't budget. Most families in American are living paycheck to paycheck. Seniors and persons serving in the military know this more than anyone. All it takes is one emergency to send them to the brink of financial disaster.

Yes, there are programs out there to help seniors and persons who have multiple expensive medications. Louisiana is the only state with a charity healthcare system. Since Katrina and Rita it is less than funcational. Not that it was any better prior to the storms. Places like the working people's free clinic help. Reality is everyday some seniors have to decide between medication and food or medication and heat in the winter or air in the summer. That is the sad state America is in.

Take your arrogant attitude and go work on your budget for next year. Make sure you pad it well, just in case that job you hold gets sent overseas or in case your trust fund goes bust.

I agree completely. Just because the city is behind in billing, it does not mean that you do not owe them money. You used the electricity and water and gas, and you must pay for it. Do people think it is a "Christmas Miracle' that they did not have bills in November?? Did they all go buy PS3 for their kids?? Get real. You should think of is as an interest free loan.

plus, as i understand it, as long as you pay something, they will not cut off your services. With the temps below freezing, I am sure you will be fine. Return some of the Christmas crap to the store and pay your bill.

Tell your brother that we would have more sympathy for policemen if they were polite to the citizens which pay them and if they spent more time stopping crime than taxing otherwise law abiding people with traffic tikets. The only reason we call police to a crime scene is to get a report. Very seldom do we see fingerprints taken or a TV CSI team. We do see cops getting discount meals, chasing women and acting like bullies. We also see off duty cops with their families driving around in police cars and using public gas. We also see off duty cops working security jobs for cash and not paying taxes on it. We also see open prostitution and drug use a few blocks away from the Alexandria Police Headquarters. We also see drugs and crime in the jails they guard. The police have a public relations problem of major size that they need to work on.

Read the article again. It says that they help the people that deserve help and don't have a bad driving record and are respectful to the cop. The oldest trick in the book is that cops stop writing tickets to punish the city financially whenever they don't get their way on a new tax or pay raise or benefit. We have a lot of good cops but you don't have to be a good cop or even an honest cop to advance thru the ranks. The police and fire civil service system is established to protect the rotten apples and eventually, thru attrition and passage of time, they end up at the top, degrading the service for everybody. The new trend is to get their 19 year old delinquent or addicted kids on the force to perpetuate the incompetence. then you get the occassional tragic fuckup even like APD and everybody puts a blue ribbon on their antenna. I hope Roy can correct some of this.

I would assume (there is that word again) a City Prosecutor has the same type of discretionary powers as a DA. One needs to understand the system in order to understand a Prosecutor's duties. A Cop enforces law - that's all. He/she arrest/ticket people. They do not try them, they do not charge them they do nothing but arrest/ticket someone based upon what they have personal knowledge off or based upon a compliant signed by an individual. Bitch as they may that is all they do so how can their morale be effected when they have done their job? They bitch because they are not all powerful.

Thnen along comes the DA/City Prosecutor. They have the legal authority to determine if the evidence supports the charges and whether or not the matter will reduced, charges stay the same or disappear completly. Like it or not the DA/Prosecutor decides who goes to trial, who can pay a fine instead of going to trial or otherwise disposes of the casze.

Judges conduct trials of those individuals referred to the Court for trial.

Never forget a Police person would bitch if they were given a free lunch - which most are. Alexandria has a fine group of Police People. 4 in a pickup truck were attacked by a Black with a beer, procurement of sex and drugs are conducted mere blocks from the station, and the extension of courtesies to fellow Police persons for infractions never ceases. How many people have been passed by Police speeding. Silent response - I already know the excuse.

Police, after 6 months, love their job and you can't run them off. Where else can someone with little education be legally provided so much authority, consider all "civilians" they come into contact with as assholes and spend their time retelling the same old stories of whose head the went upside.

When one realizes the hours Police people work versus their actual income it ain't bad. The cute part is gonna be when an incident happens with one of these Police Persons working as a rent-a-cop in their City of uniform and the City of gets sued. Don't know of any other folks that would assume that much liability but the City of seems happy to do it and the merchants hiring the rent-a-cop is glad to let the City do it.

Traffic tickets represent a significant revenue stream for the city and parish courts so I seriously doubt that they are dismissing a majority of them. It is the prosecutor's duty to determine what course of action would best further the cause of justice and they have enormous discretion in that regard. The cops would like to be the ultimate authority on who gets punished and how much but they, in fact, have and exercise their own judgment on what to charge and how fast to say the driver was going and they frequently do their own little roadside justice by reducing the charge to a lower speed or a nonmoving violation. If you go to the Alexandria city prosecutor's office on traffic day you will see that he has an office full of cops trying to get help for their friends. And the cop they caught steeling tires, in uniform, on duty, was given a tap on the wrist and allowed to go on worker's comp. The cops that beat up their wives usually get a letter in their file instead of going to jail for 30 days like anyone else. Newman Bob, head of Alex Narcotics cops and buddy of Daren Coutee, was caught lying on the stand in court and admitted as much but is now in a position of authority at APD. Rennier who was convicted of battering that guy and had numerous other complaints is now in charge of a shift. None of them live in town. It goes on and on. And they will pull some kind of chickenshit strike in a heartbeat.

The Town Talk was able to obtain a copy of the letter sent to Ratcliff construction company that outlines the numerous defects with the Performing Arts Center they constructed for the City. This looks very bad for Ratcliff. I wonder how or if they will respond. Hope their insurance is paid up.

OK here's the dumbass question of the day on the Arts Center building - who the hell was inspecting the building for the City as it was being constructed? Typically if you are the developer, you inspect the project as it moves along to sign off as it goes through stages to allow the contractor to make draws on the construction money. Soooooooo, who was signing off during the construction phase to allow Ratcliff to be paid? Someone had to be unless he waited until everything was completed and got one big fat check at the end (which I seriously doubt). Wasn't Delores the delightful in charge of capital projects? Is she the one that ok'd this shotty workmanship? Is there no fault on the person who was signing off for Ratcliff?

Hey - believe me I am not on the side of the contractor here, I'm just wondering which idiot at the City ok the crappy work and the work which apparently was not performed to spec. Someone had to and I want to know who. That to me is just as important as getting the building fixed.

You idiot assholes don't know jack. There is no such thing as Pineville City Court. The actual structure is a WARD court for Wards 9, 10, and 11. Truth be known, Pineville's mayor...what's his name, has NO AUTHORITY over court business. The court is totally under the control of Judge Phillip Terrell.

Gary hayes IS the city's lawyer. He represents the ANY police force who writes a ticket IN THE CITY. Tickets written outside the city, by state police and sheriff's department do to the DA and 9th JDC.

The Mayor of Pineville appoints Hays and can fire him. The judge hands down fines and can disreguard Hays' recomendation if he chooses. Keep in mind that the City gets the fine for the offense, but the judge gets the court costs and they NEVER are reduced. In pineville you pay $138 in court costs for a $25 violation.

The court is going to get their pound of flesh, no matter what.

Hays has always been a lazy, spineless lawyer who will not do his job. For him, it's quicker to plead down ALL the tickets and just submit a written report to the judge. The judge approves whatever Hays gives him and collects $138 a pop. On a typical day the court might hear 30 to 40 tickets, that's almost five grand in court costs per day. Terrell rakes that in. Hays gets paid by the city for rubber stamping the tickets. He's in and out of court in about 3 hours. Since they hold court only 2 times a week, that's pretty good cash for 6 hours work.

It's a hellava racket. Sweet deal for the players, raw deal for us.

Actually, Pineville City Court only has criminal jurisdiction in Oineville, but has civil jurisdiction in Wards 9, 10 and 11 (the entire north side of the river). The City of Pineville gets a portion of the fines and fees from criminal matters. The law requires the City of Pineville and the Police Jury to pay for the courthouse, however, for almost a decade the courthouse has mostly become self-funding. The City makes a profit of almost a half of million dollars off the court. One gripe the City has had is that it desires Judge Terrell to fine people the maximum fine, which he refuses to do and gives people with hardship the ability of paying fines and costs in installments rather than going to jail. As a judge, Terrell has a duty to decide each case and the circumstances of each defendant on its own particular merits.

Typically a City has an Engineering firm representing the City on large projects. The City lacks the expertise to properly manage a large projects with the many different elements and the Engineering firm supposedly has on board graduate Engineers well versed in their particular discipline. In theory a project is inspected numerous times during construction by the City Inspectors and the Engineering firm's Engineers.

Upon project completion the Engineering firm renders a report to the City recommending Acceptance. The project normally is warranted for a certain number of years against latent defects. Latent is construed to be hidden or unknown defects not obvious defects in material and workmanship that should have been caught during construction.

The City's report is just that - the City's report. It is a report prepared by a firm hired by the City and should place the blame upon everyone but the City and the City's Consultant Engineering firm. After all if the report found the City at fault how much investigating business would a firm of this nature expect to receive from a governmental agency. The same firm hired by the prime contractor or a subontractor would find that the building was built according to plans and specifications and the design Engineers are at fault.

This ain't no new Rodeo nor will the matter be settled in a short time frame. The firms alledged to be at fault by the City will hire their own inspectors and they will determine their own facts. Then it will go to Court. Then the Judges decision will be appealed, etc, etc.

An interesting question would be who inspected and accepted the masonry work as installed per plans & specifications? If the weep holes are clogged with morter what is the test procedure that should be done prior to Acceptance? Who tested and who witnessed the tests.

Depends on the law firm's contract. If the firm is handling the case for a fixed fee or on a contingency basis, it is in the firm's interest to resolve the case quickly. If, as is usually the case on a controversy like this, the firm is paid by the hour, then it is in the firm's interest to drag it out, litigate, and generate as much bullshit paper as possible. This is an unfortunately common practice among large firms know as "stirring the file". When the smoke clears you will see that the cost of repair is chicken feed.

That is not the case. As a lawyer gets more fee from the size of the award to the client, a contingency fee lawyer does not settle for peanuts just to be fast. Also, any settlement has to be approved by the client.
Now it is true that by the hour fees do often entail unnecessary work by the attorney, which can add up to more hourly billings.
Also, I find it rather hypocritical for many to favor the hiring of local people, when the City sought an out of town lawyer, of any color, and many larger concerns use out of town contractors.

Yes, but a contingency fee lawyer usually has to work that file before the award gets up to the point that is acceptable. Insurance companies, which are most of the contingency fee cases, usually do not offer what the case is actually worth from the outset. And how well the lawyer works that file, i.e. medical depostions, preparing for trial and etc..., is what brings the award up higher. No doubt the attorney from the insurance company may not want to settle until he has gotten his billing in, but a plaintiff's lawyer DOES NOT desire to settle the case fast if it is a settlement offer below the norm. The insurance adjuster, or its attorney, can tell if the plaintiff's lawyer has not worked the case and is just bluffing on going to court.

We talk about racism frequently, but when the blacks in Dollar Bill Jefferson's district reelected him to Congress, they effectively reduced Louisiana's representation to six Congressmen and put a blot on our state which will cost multimillions of dollars in funds we would otherwise obtained post Katrina for rebuilding N.O. and the coast. I contend this was a racist vote by blacks just as the O.J. Simpson vote. I do not believe just because you are black you can be 100% racist and not be called on it. Even though his opponent was a woman and black, the racist element comes in to play when the black voters wish to unite behind a man who's only excuse is that the white power structure is just against blacks, even though he has obtained wealth, power and a Harvard degree for himself and his daughters. A man with his intelligence could have done wonders for his district and La. and could have become its first black governor but for his immorality and dishonesty. But now his very appearance in the halls of Congress will cost La. citizens everywhere everyday.

New Orleans is not now, nor has it ever been worth a shit politically. It was conceived as a pirate town and never evolved. Impoverished minorities were volutarily kept in economic slavery so that they would be neither productive nor independent but would just be maintained as a pool of votes and a source of political power. The blacks didn't do that, the white folks did. And now, that those blacks have been busy creating more blacks for 5 generations, we end up with the old Frankenstein story: we created a monster and it killed us. Katrina, in some form, had to happen. A creature like New Orleans can't go on forever. Never-the-less, there has got to be some reason that the feds haven't dropped on Jefferson yet - I wish we knew. Is it possible that the republican justice dept. just wants to keep this Jefferson think on the front page for political reasons? Didn't work in '06.

We'd elect Edwin Edwards if his name appeared on the ballot. NOLA picked Nagin for four more years over a possible 8 years of the Landrieu machine. And now Jefferson. There have been times when we have been forced to choose the lesser of two evils, but sometimes, we just do stupid things to ourselves and then wonder why people on the outside talk about our currupt politicians.

We have much to overcome to get past the image of 3 insurance commissioners going to jail, a former governor in jail and god knows how many other politicians under investigation for ethics violations. When we shoot ourselves in the foot, we have no one to blame but ourself. We make a few baby steps forward by having 8 years of scandal free government in the Governor's house with Foster and then go completely down the tubes with Blanco's handling of Katrina. Miss Black America, Black Legislative Caucus, United Negro College Fund, Black Entertainment Television, Nation Association for the Advancement of Colored People, just to name a few, clearly shows that Blacks are more racist. The causes? Black unwillingness to assimilate into American Society, Blacks thinking that it is now their turn, and moving from inequality of the races to superiority. Until the American maxim of "Equal" protection of the laws truly applies "equally" to all, with no job quoatas, minority contract and just a united college fund instead of a Negro one, we will stay with racial problems. Also, until all people, red, black white and yellow, learn to accept responsibility for their own crimes and wrongdoings we will keep conflicts.

Non jews. Leaders in many groups publicly deride Jews. Farakhan and Jesse Jackson among the blacks. All muslim countries. David Dukes and KKK types. White supremicists, Nazis, Catholics, Christians and hidden animosity kept hidden because it is socially unaccepted. Jews keep silent and protect themselves with their intelligence and wealth and don't have time to prejudge their enemies. It seems the more enlightened, intelligent and intellectually honest an individual is, the more tolerant and less racist he is. I know many blacks who deplore the welfare, medicaid, food stamp, rent subsidy, free housing, and get out of jail free cards many blacks carry and many whites who cringe when the red neck, ignorent white peck trash comes down on blacks. This leaves us with rational folks of all races, religions, no religions, nationalities, trades, professions and other minority groups who can get along without conflicts. If more of us in this last group point out the immorality of those in the other groups, maybe we can converse on an intellectual basis without bias, namecalling and insulting innuendo. Maybe. Who knows?

Saw where Brent Caplan is now the chamber president. Let's see, he built a $2,000'000 building that nobody goes to, and stopped the upgrading of the south circle, just as his dad and brothers impeded the I-49 loop originally proposed. Both for personal interests affecting their stores and property value. I-49 going downtown cost us millions and still their property and business went tits up. He has no experience other than sucking the silver spoon he was born with. Never had a real job, consumed the product of his parents labor and shot off his mouth about things of which he knew nothing. How can he lead the chamber and where the hell is the chamber going under his leadership. We wonder why Alexandria is being pulled under just like it has for the last 50 years.

A friend of mine from rotary tells me her husband of 11 years has left her for Monica Walker. Her husband is a high ranking administrative employee of Cabrini Hospital. They apparently carried on a "friendship" for quite a while making dates right under her nose. He is taking her to all of the high profile parties and even took her to the grand opening of our new terminal building last Friday. Wonder what she did with her husband. I think the one she just dumped is #4. Since my friend would not move out of her house, he has moved in with Monica supposedly paying her approx. $2000 a month to live there. My friend went to the Diamond Grill after the grand opening and there they were together. Monica even raised her glass to my friend in a "victory" toast. What a gal! Do you think they will probably re-elect her too! Maybe they'll sew a scarlet letter on her chest. A real class act.

In case you have forgotten, segregation was the law of the land and many of these organizations were created in direct response to that circumstance. Grambling and Southern exist because blacks were prevented from getting a college education at LSU or Tulane. Let's be real here folks!! To say that black people are MORE racist is idiotic!

They did the right thing once they recognized that their friendship was turning into more. Divorce is painful for all involved, particularly for spouses who didn't want a split.
